<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that upon the death of the said
<br />Fred Miller the real estate hereinbefore described passed and descended under the intestate
<br />laws of the state of Nebraska,in force at the time of the death of the said Fred Miller,by
<br />absolute title as follows; a homestead estate and an undivided one -third of the fee simple
<br />title to Edna Miller,surviving widow of the said Fred Miller,deceased;and an undivided two-
<br />ninths each in fee to Beatrice Miller,Marjorie.Miller,and Frederick Miller ,daughters and son
<br />of said deceased,subject to the homestead estate therein of the said Edna Miller,and distri-
<br />bution thereof is hereby accordingly made.

<br />j petition of Edwin A.Jones, Senior, heretofore filed herein, praying that the Court determine
<br />and find the date of the death of the said Georgia L.Jones, deceased, that the said Georgia
<br />L.Jones died intestate, that the heirs at law of the said Georgia L.Jones be determined by tt
<br />Court, and their respective degree of kinship fixed, and that the right of descent of the
<br />G real estate of the said Georgia L.Jones, deceased, be determined, and it appearing to the
<br />Court, from the proofs on file, that due and legal notice, by publication, has been given,
<br />as by law and the order of this Court required, to all creditors, heirs and persons interest-
