0 A-I& 4 EA11 UTUM1911 11;�5 <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY NEBRASKA. <br />In the matter of the estate <br />of Fred Miller, FINAL DECREE <br />Deceased. <br />Now,on this 20th day of October,1926,this cause came on for hearing upon the final report <br />of Edna. Miller,Administratrix of the estate of Fred Miller,deceased,and upon her petition <br />for the settlement of said estate and her discharge herein,and the Court having examined <br />the records and files and being fully advised in the premises,finds that due and legal <br />notice has bean given to all persons of the time and place fixed for a hearing upon said <br />report and petition,and no one appearing to object thereto and the Court having examined <br />said report,together with the vouchers on file,and being fully advised in the premises,finds <br />that said report is true and correct in all things and that the same ought to be approved <br />and allowed as and for the final report of said Adminlistratrix,said estate settled and <br />closed and said Administratrix discharged. <br />The Court further finds that due and legal notice has been given to all persons of the <br />time and place fixed for filing claims against the estate of said deceased,and that the <br />the time so fixed has fully expired,and that all persons having claims against said estate <br />and not filed trithin the time limited,if any such there be,are forever barred and excluded <br />from setting up or asserting any such claims against said estate. <br />The Court further finds that said Administratrix has paid all claims filed against said <br />estate,the costs of this proceeding,and that nothing remains in the hands of said Adminia- <br />tratrix belonging to said esta.te,and that the estate of the said Fred Miller,deceased,was notl <br />subject to an inheritance tax under the laws of the state of Nebraska,or to a Federal estate <br />tax under the laws of the United States. <br />The Court further finds that said Fred Miller died intestate the owner by fee simple titlel <br />absolute of Lot 2,in Block 136,in Union pacific Railroad Company's Second Addition to the <br />city of Grand Island,in Hall County,Nebraska,and that said real estate was the home and <br />homestead of the said Fred Miller and Edna Miller ,his wife ,at the time of the death of the <br />said Fred Miller,and that said Edna Miller has a homestead estate therein. <br />The Court further finds that the said Fred Miller left surviving him,as his heirs at law <br />and his only heirs at law,the following named persons: Edna Miller his surviving widow,and <br />Beatrice Miller, <br />mother of all the children of the said Fred Miller,a daughter,of lawful age,Marjorie Miller, <br />A <br />a daughter,of lawful age,and Frederick Miller,a, son,aged fifteen years,and that under the <br />intestate laws of the state of Nebraska in force at the time of the death of the said Fred i <br />Miller,the real estate hereinbefore described passed and descended,by absolute title,as j <br />follows: To Edna Miller,surviving widow of said deceased,a homestead estate therein and one - <br />third of the fee simple title thereto,and to Beatrice 14'iller,Marjorie Miller,and Frederick <br />f <br />Miller,daughters and son of said deceased,each an undivided two- ninths thereof,subject,how- <br />ever,to the homestead estate therein of the said Edna Miller,surviving widow of said deceased, <br />IT IS,THEREOFRE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of the <br />said Edna Miller,as Administratrix of the estate of the said Fred Miller,deceased,be,and the <br />same hereby is,in all things,approved and allowed as and for her final report,said estate <br />is herebla settled and closed,and said Administratrix discharged. <br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all persons having claims <br />against the estate of the said Fred Miller,deceased,if any such there be,are forever barred, <br />excluded,and enjoined from setting up or asserting any such claims against said estate. <br />
