<br />of the claim of Will and Henry Thaden have been paid and satisfied and that the claim of
<br />Will and Henry Thaden has been disallowed as an improper claim against said estate,and
<br />that said claim and any claims not sm filed if any such there be,are forever barred and
<br />precluded.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that all claims filed against said estate
<br />with the exception of the claim of will and Henry Thaden have been -paid - -and -that- the claim
<br />o Will, anli Henry Thaden and any 'other claims: not -to- filed, ifs, any 'such there be, should be
<br />Ana the- same ,are -hereby forever barred ands precluded.
<br />The Court further finds that said Christina E.Porth,deparfed this life on the 7th.day of
<br />February,1926,while a resident and inhabitant of Hall County,Nebraska,and that she died in
<br />testate;that the said Christina E.Porth left surviving her as her heirs at le,w and only
<br />heirs at law Charles A.Porth,her husband and Martha C.PorthAnna M.Porth,Mabel A.Porth and
<br />Maynard C.Porth,her children;that at the t ime of her death the said Christina E.Porth was
<br />the owner in fee simple of the following described real estate,to -wit:
<br />The west Half of the Southeast Quarter (WJ SEJ) of Section Twenty -eight (25),Township
<br />Nine (9) North,Range Nine (9),West of the 6thP.M.,Hall County,Nebra.ska,and that she was
<br />possessed of personal property as shown by the inventory filed herein.
<br />The Court further finds that all of said property,both real and personal passed and
<br />descended under and by virtue of the laws of descent in the State of Nebraska,as follows:
<br />To Charles A.Porth an undivided one -third (j) interest therein atd -to Martha C.Porth,
<br />Anna M;Porth,Mabel A.Porth and Maynard C.Porth;jointly,a two - thirds (213) interest therein.
<br />The Court further finds that said Administrator has made distribution of the personal
<br />property in the manner and proportion herein set out for which receipts are on file in this
<br />court.
<br />The Court further finds that there is no inheritance tax due from any of said heirs on
<br />account of their interest in said estate and that said real estate did not constitute the
<br />homestead of the deceased and that Charles A.Porth has no homestead interest therein.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that the West Half of the Southeast Quarter
<br />(W2 SEJ) of Section Twenty -eight (28),Township Nine (9) North,Range Nine (9),West of the
<br />6th.P.M.,Hall County,Nebraska,passed and descended under and by virtue of the laws of des-
<br />cent in the State of Nebraska,as follows,to -wit:
<br />To Charles A.Porth,an undivided one -third (j) interest therein and to Martha C.Porth,
<br />Anna M.Porth,Mabel A.Porth and Maynard C.Porth,jointly,an undivided two - thirds (213) in-
<br />terest therein,and the same is hereby awarded to them,to have and to hold to them and their
<br />heirs forever.
