<br />-IN THE COUNTY COURT OF HALL COUNTY;NEBRASKA.
<br />IN THE MATTER OF-THE ESTATE OF
<br />MARY BARTELS DECREE._
<br />DECEASED.
<br />Now on this 29th.day of July,19261this cause came on for hearing upon the petition of Fredf
<br />Bartels,husband of the deceased,praying for a settlement of the Estate Of said deceased and
<br />a determination of her heirs and the right of descent of her property and the degree of kin-
<br />ship of said-heirs at law,and it appearing from the proof on file herein that due and legal
<br />notice by publication for three successive weeks as by law and the orders of this court
<br />required,has been given to all oreditors,heirs at,law and persons interested in said estate of
<br />the filing of said petition and of the time and place of hearing the same.which time was more,than
<br />thirty days and less than sixty days after the filing of said petition,and there being no obj0ot-
<br />ion made thereto and no one appearing to object in person.the said cause was duly submitted
<br />to the Court upon the petition and the evidence of the petitioner in supptrt thereof and the
<br />Court being -fully advised in the premises finds that the allegations of said petition are
<br />true;that said Mary Bartels died intestate in Grand Island,Nebraska,on the 15th.day of June,
<br />1921 and that at the time of her death she was a resident and inhabitant of Hall County,Neb-
<br />raska;that more than two years have elapsed since her death and.that no application has
<br />been made in the State of Nebraska,for the appointment of an administrator of her estate,and
<br />that no administration has been had of her estate. That the deceased left an estate consisting
<br />of a fee title to Lot Three (3) and an undivided one-half (1) interest in Lot Four (4) of
<br />Block Two (2) of Schimmer's Addition to the City of Grand Island,Hall County,ll.ebraska.
<br />The Court further finds that said Mary Bartels left surviving her at her heirs at law
<br />Fred A.Bartels
<br />and only heirs at law.Fred Bartels,her husband William H.Bartels A John N.Bartels,Martha Koch,
<br />Marie Eriksen,Sophia Bartels,Otto B.Bartels and Henry L.Bartels;her children.
<br />The Court further finds that upon the death of said Mary Bartels,all of her property of
<br />whatsoever nature and kind passed and descended by operation of law as follows:
<br />To Fred Bartels,her husband;an undivided one-third (J) interest therein,and to William
<br />Fred A.Bartels
<br />H.BartelsiJohn N.Bartels,Martha Koch,Marie Eriksen,Sophia Bartels',Otto T.Bartels.and Henry L.
<br />Bartels,each an undivided one-twelfth�(1/12) interest therein.
<br />The court further finds that all funeral expenses of said deceased have been paid and that'
<br />all debts of said deceased and of her estate,if any exist are forever barred and precluded an4
<br />that the costs of these proceedings have been paid.
<br />IT IS,THEREFORE;ORDEREDIADJUDGED AND DECREED BY THE COURT that the said Mary Bartels died
<br />intestate more than two years prior to the filing of said petition in this cause;that no
<br />application for the appointment of an administrator of her estate has been made and there has,been
<br />no administration of her estate in the State of Nebraska;that she died possessed of the fee
<br />title to Lot Three (3) and an undivided one-half (1) interest in Lot Four (4) all in Block Two
<br />(2),Sohimmer's Addition to the City of Grand Island,Hall County.Nebraska,and that said property
<br />passed and descended by operation of law as follows:
<br />To Fred Bartels,her husband2an undivided one-third O interest,and to
<br />William H.Bartels.Fred A.Bartels,John N.Bartels,Martha Kooh,Marie Eriksen,Sophia Bartels.,
<br />Otto T.Bartels and Henry L.Bartels)each an undivided one-twelfth (1/12) interest,and the same,
<br />is hereby awarded to them and each of them as provided by law;thdt all debts of said deceased:
<br />or of her estate if any exist ,are forever barred and precluded and that further administratioll
<br />of her estate is hereby dispensed with and said Estate is settled and forever closed.
