<br />Now on this 22nd day of July, 1926, this cause came od.for hearing upon the petition of
<br />Minnie M. Sherlock, and the Court being fully advised in the premises, finds that notice has
<br />been given in proper form as provided by law; and this cause coming on further to be heard
<br />upon the petition of Minnie M.Sherlock and the testimony of Harold A.Prince, in consideration
<br />whereof, the court finds as follows, to -wit:
<br />That Mertie D.Elliottdied intestate in Hall County, Nebraska on the Tth day of A pril
<br />1921; that she.was at the time of her death resident of Hall County, Nebraska; that she
<br />left as her heirs at law and her only heirq at- law the following named persons: Peter
<br />Elliott, her husband, Nelson M.Elliott, her son, Sylvia D Burry, formerly Sylvia D.Elliott,
<br />daughter; Florence M. Dickerson, formerly Florence M. Elliott, a daughter, and Minnie M.
<br />Sherlock, formerly Minnie M.Elliott, a daughter, all of lawful age.
<br />The Court further finds that Minnie M. Sherlock is an heir of the deceased and has
<br />derived title to an interest in real property from the said deceased.

<br />The Court further finds that at the time of the daath of the Mertie D.Elliott, she was
<br />the owner of an undivided one -half interest in and to the following described real estate,
<br />to -wit: The north half (NI) of the Northwest Quarter (NW I) of Section Twenty -one (21),
<br />Township Twelve (12), North, Range Twelve (12), West of the 6th P.M. in Hall County, Nebraska.
<br />The Court further finds that said deceased left no last will and testament, and that
<br />no application has been made in the State of Nebraska for the appointment of an Administrator
<br />of the estate of Mertie D. Elliott, deceased, either by her heirs or by persons claiming to
<br />be creditors of said deceased.
<br />The Court further finds that more than two years have elapsed since the death of the
<br />said Mertie D .Elliott.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY the Court that the said Mertie D.
<br />Elliott died intestate on the 7th day of April, 1921;. that she left as her heirs at law
<br />and her only heirs at law she following named persons:
<br />Peter Elliott, her husband,
<br />Nelson M. Elliott, a Son,
<br />Sylvia D. Burry (formerly Sylvia D.Elliott), a daughter;
<br />Florence M.Dickerson (formerly Florence M.Elliott), a daughter;
<br />Minnie M Sherlock, (formerly Minnie M.Elliott), a daughter;
<br />and that upon her death her interest in said above described real estate passed and
<br />descended as follows, to -wit:
<br />! An undivided one -third interest therein to Peter Elliott:
<br />An undivided one -sixth interest therein to each of Nelson M.Elliott, Sylvia D. Burry
<br />(formerly Sylvia D.Elliott), Florence M.Dickerson (formerly Florence M.Elliott) and Minnie
<br />a.Sherlock (formerly Minnie M.Elliott).
