<br />In the Matter of the Estate of

<br />Now on this 7" day of May,1926,this cause came on for hearing upon the Petition of Edward
<br />Hostler,heretofore filed herein,praying for a settlement of the estate of said deceased,a
<br />determination of the heirs of said deceased and degree of kinship and the right of descent
<br />of her real estate,said petitioner bein �Iepresented by Horth,Cleary & Suhr,his attorneys,and
<br />it,-..appearing from the proof on file that due and legal notice of publication in The #rand
<br />Island Independent,a legal newspaper printed in Hall County,Nebraska,for three consecutive
<br />weeks as by law and the order of this Court required,has been given to all creditors, heirs -
<br />at -law and persons interested in said estate of the filing of said petition and the time and
<br />place for hearing thereof,which time was more than 30 days and less than 60 days after the
<br />filing of said petition,and there being no objections thereto,said cause was duly submitted
<br />to the Court on said Petition and the evidence of the petitioner in support thereof,and the
<br />Court being duly advised in the premises finds that the allegations in said Petition are
<br />true;that the said Bertha Hostler died intestate in Hall County,Nebraska,on the 9th day
<br />of November,1923,gnd at the time of her death she was a resident and inhabitant of the said
<br />Hall County,Nebraska;that more than two years have elapsed since her death and no application
<br />has been filed in the State of Nebraska,or elsawwhere,for the appointment of an Administrator
<br />of her estate,nor petition filed therefor and that no a dministratlon has been had upon her
<br />said estate at any place.
<br />The Court finds that the said deceased left surviving her as her sole and only heirs -at-
<br />law,the following named,all with the exception of Edward Hostler,the surviving husband,being
<br />minors under the age of 21 years and all being residents of Hall County,Nebraska,to -wit:
<br />Edward Hostler,surtiving husband of said deceased.
<br />Frank Edward Hostler,a son,
<br />John HcnYy H3stler7a-son,
<br />Anna Louisa Hostler,a daughter,
<br />Mary Hannah Hostler,a daughter,
<br />Sadie Rosella Hostler,a daughter,
<br />Ida Bertha Hostler,a daughter,
<br />Edward William Hostler,a son,
<br />Dorothy Etta Hostler,a daughter.
<br />That said deceased died,seized as the owner of an estate of inheritance in and to the foll-
<br />owing described premises situated in Hall County, Nebraska, t o-wit:
<br />And undivided one -ninth interest in and to the following:
<br />The East One -half of the Northeast One- quarter (EINEJ) and the East 011e -half of the South-
<br />east one - quarter (E SEJ) of Section Three (3) in Township Twelve (12) North of Range Ten
<br />(10). in said Hall County,Nebraska.
<br />The Southeast uarter of the Southwest
<br />Q Quarter ( SEJSWJ) and fhe Southwest Quarter
<br />of the Southeast Quarter (SW4 SEJ) in Section Thirty -six (36) in Township Twelve (12) North
<br />of Range Ten (10) in said Hall County,Nebraska.
<br />Lot Five (5) in Block Twenty -three (23) Russell Wheeler's Addition to the City of Grand
<br />Tsland,Hall County,Nebraska.
<br />Lot Four (4) in Block Nine (9) in the Original Town,now City,of Grand Island,Hall County,
<br />Nebraska.
<br />And the following described real estate situated in Howard County, Nebraska to-wit:
<br />The North One -half of the Northwest Quarter (N2 NWJ) of Section Sixteen (16) in Township
<br />Thirteen (13) North of Range Ten (10) in said Howard County,Nebraska.
<br />The West One -half (W2) and the North -east Quarter (NEJ) of Section Twenty -six (26) in Town-
