<br />.; IN THE MATTER OF THE ESTATE
<br />OF FINAL DECREE.
<br />JESSE C.BURKERD,DECEASED.
<br />Now on this 30th day of January2l926,this cause came on for hearing upon the final report
<br />of Fred J.Burkerd and Edwin T.Rounds,Executors of the last will and testament of Jesse C.
<br />Burkerd,deceased,it satisfactorily appearing to the Court from the proof now on file that
<br />notice as required by law was given to all persons interested,as to the filing of said report,
<br />and the time fixed for;'final settlement of said estate,and that no one has appeared to object
<br />to or protest against the allowance of the account of said executor.
<br />ON examination thereof the Court finds that said report is correct in all respects and ought
<br />to be allowed,and that the executors have accounted for all of the estate of said deceased com-
<br />ing into theirhands or under their control,have paid all claims filed and allowed against the
<br />estate of said deceased as well and the costs of administration andhave distributed the re.
<br />mainder of the personal property among the.legatees under the will in accordance with the terms
<br />thereof,and that no money or other personal property remains in their possession for distribution.
<br />THE COURT FINDS that notice was given to all creditors of the said Jesse C.Burkerd as to the
<br />time allowed and place appointed for filing claims against said estate and that the time here*.
<br />tofore allowed for filing claims against said estate has fully expired;that all claims out-
<br />standing against the estate of said deceased not filed within the time limited for filing claims
<br />are therefore barred.
<br />IT IS THEREFORE CONSIDERED BY THE COURT that the report of the executors of the last will $Lnd
<br />testament of Jesse C.Burkerd,deoeased,be and the same is hereby approved and allowed as and f6r
<br />their final account and their bond is released.
<br />IT IS FURTHER CONSIDERED BY THE COURT that all persons are forever barred from filing or
<br />setting up any claims or demands against the estate of Jesse C.Burkerd,deceased.
<br />THE COURT FINDS that the said Jesse C.Burkerd died possessed in fee of the following des-
<br />cribed real estate situate in the county of Hall and State of Nebraska,to -wit.
<br />Lot Two (2) in Block Nineteen (19) in the Original Town of Wood River and Lots.Seven (7),
<br />Eight (S),and Nine (9) in Block Seventeen (17) in the Original Town of Wood River.
<br />THE COURT FINDS that the said Jesse C.Burkerd departed this life on the 2nd day of October,
<br />1922,that he left a.`last will and testament,which instrument was duly proved,allowed,and ad-
<br />witted to probate in this court on the 4th day of November,1922,and recorded in this office;
<br />that the testator,was at the time of his death a resident and inhabitant of Hall County,Nebraska.
<br />THE COURT FINDS that under the terms and provisions of said last will and testament the above
<br />mentioned and described veal estate did pass and descend at his death in the manner following'
<br />Lots Seven,Eight,and Nine in Block Seventeen in the Town of Wood River,Hall County,Nebraska,to
<br />Sarah M.Burkerd,the widow,for the term of her istural life and that at her death said real estate
<br />passes and descends in equal shares to Nettie A.Rounds,Fred C.Burkerd,children of,the Testator,
<br />and Erma J.Wiggins,Lawrence E.Hooton,and Alice B.Hooten,grandohildren,in absolute title::and Lot
<br />Two in Block Nineteen in the Original Town of Wood River,Hall County,Nebraska,did pass and deer-.
<br />cend,at the death of said testator,under the provisions of his last will and testament,to Nettie
<br />A.Rounds,Fred C.Burkerd,Erma J.Wiggins,Lawrence E.Hooton,and Alice B.Hootbn,in equal shares as
<br />tenants in common,to have and to hold to them and their heirs and assigns forever.
<br />IT IS THEREFORE CONSIDERED,ADJUDGED AND DECREED that all of the right,title,and interest of
<br />Jesse C.Burkerd,in and to Lots 74,and 9,in Block 17,in the Town of Wood.River,Hall County,Neb-
<br />raska,did pass at his death,under the terms of his 3ast will and testament,to Sarah M.Burkerd,for
