<br />That at his death said decedent was seized and possessed of, the following described real
<br />estate,to -wit: The South Nest Quarter of Section No.12,and the South West:Quarter of Section

<br />No.34,all in Township IcA.11,north,of Range No.13 west of the 6th.P.li¢. in Buffalo County,
<br />Nebraska;Also the South East Quarter of Section No.61in Township No.11,north,of Range No.12,
<br />jj west of the 6th. P. M. in Hall County,Nebraska; a.nd. also the South West Quarter of Section 25,

<br />in Toi nship No. 3,north,of Range No. 24 west of the 6th P. M. in Furnas County,Nebraska,and that

<br />said SW-. of Said Sec.12,was the homestead of said decedent at his -death,and was then occupied
<br />i
<br />jI as such by himself and his said heirs.
<br />3rd.
<br />That a period of six months has been allowed by order of this court for the creditors of
<br />said estate to file herein their claims for adjudtment and allowance,and due and lawful notic
<br />of said period,of its limitation and the time and place of hearing on said claims has been
<br />given as required by said order. That said period has elapsed and all such claims,if any
<br />there be,a.re now forever barred from being filed,heard or allowed in any action or proceeding
<br />whatever. That all claims allowed; all orders and allowances for the payment of moneys; all
<br />the funeral,burial and memorial expenses,a.nd the expenses of the last sickness of said de-
<br />ceased; a.nd all the costs and expenses of this administration have been fully paid and satisfi d.
<br />4th.
<br />That all of said estate upon the death of said decedent by virtue of the laws of the State
<br />of Nebr -ska then in effect,then and thereby descended to and vested in said heirs in the follow_
<br />! ing proportions, shares and int erestg, to -Suit: to said Emma L.'uhlbach an undivided one third
<br />I part share and interest in and to said personalty,and a homestead right and interest in and
<br />I
<br />to said 9771 of said Sec.12,with the right to possess,use and receive to her own exclusive-
<br />enjoyment and ownership all the income and profit thereof during her natural life,and the un-
<br />divided one third part share an. interest in and to all of said real estate subject only to
<br />jj said homestead right; and to each of said Henry E. Muhlbach,Hulda A. Eichkoff, ".ginnie E. Iluhlbach,
<br />Fred A.''uhlbach and. Richard E. ',iuhlbach a two-Fifteenth (2/15) part,share and interest in
<br />and to said personal estate and also to them each an undivided two fifteenth part,share and
<br />interest in and to all of said real estate subject only to said homestead and right and interest.
<br />That neither the said esta.te,nor any of said heirs is liable for the payment of inheritanc
<br />tax in this matter,and that Albert B. Tollefsen,,County Attorney of said county,is present
<br />in open court and declines to object to this finding.
<br />5th.
<br />That it is for the best interests of all concerned in said estate that the same be not di
<br />tributed among said heirs at present;that said report and account be,and the same hereby is i
<br />all things adopted, approved, ratified and confirmed as the final administration account in
<br />said matter;that said Emma L.Muhlbach be,and she hereby is appointed trustee to care for,con-
<br />trol and manage the said estate for said on behalf of,and fort hgases and benefits of said hei s,
<br />and in accordance with their respective rights and interests in and to the same,and subject
<br />to the future orders of this court,and in the manner required by law;that she enter into bond
<br />for that purpose conditioned according to law with sureties to be approved by this court,
<br />in the penal sum of $5000.00 to gether with her proper oath in the oremises,and that there-
<br />upon proper letters and commission therefor issue to her as such trustee under the -hand and
<br />seal of this court; that she filed herein her proper and complete inventory of said trust estat
<br />and that thereupon she be duly exonerated and discharged of her said administration trust
<br />in the manner and form customary to the practice of this court in the premises.
