NEB.... <br />ff <br />DECREE <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA <br />IN THE MATTER OF THE ESTATE <br />OF DECREE <br />LAURA L. P ITT S , DECEASED. <br />Now on this 15th day of February,A.D.1926,this cause came on for hearing upon the petition <br />of Emma A.Callier,heretofore filed herein,praying that the court determine and find the date <br />of the death of the said Laura L. Pitts;,that the said Laura L.Pitts died intestate; that the <br />heirs -at -law of the said Laura L.Pitts be determined by the Court and their respective degree <br />of kinship fixed; that the right of descent of the real estate of the said Laura L.Pitts be <br />determined. And it appearing to the court from the proofs on file and from the evidence in <br />said case that due and legal notice by publication has been given by law and the order of <br />this court required,to-all creditors,heirs and persons interested in the estate of said de- <br />ceased,of the time of the filing said petition and of the time and place fixed for the hearing <br />thereon,whic% time was for more than thirty days and less than sixty days after the filing <br />of said petition and there being no objections thereto,said cause was duly submitted to the court <br />upon the petition and evidence adduced by the petitioner in support thereof and the court <br />being fully advised in the premises finds that the said Laura L.Pitts died intestate in Colum- <br />bus,Franklin County,Ohio,and at the time of her death the said Laura L.Pitts was a resident <br />and inhabitant of Franklin County,Ohio,and said Laura L.Pitts died seized of an estate of In- <br />heritance in real estate located in Hall County,Nebraska,consisting of the ownership in fee <br />simple title of Lots Ten (10)land Twelve (12) in Block Eighteen (18) in College Addition to <br />West Lawn in the City of Grand Island,Nebraska;that more than twenty -five years havelapsed <br />since the death of the said Laura L.Pitts and no application has ever.. , been made in the State <br />of Nebraska for the appointment of an Administrator of said Estate nor has administration upon <br />the Estate of the said Laura L.Pitts ever been had in the State of Nebraska ;that the petitioner <br />herein is now the owner of said premises thru purchase by WarrAnty Deed,and that she is a <br />competent andproper person to institute and prosecute this proceeding. <br />The Court further finds that the said Laura L. Pitts,left surviving her, the following named <br />heirs- at- law,to -wit: Murray G.Pitts,a son,Olive L. Syfert,a daughter,Charles B.Pitts,a son and <br />Almon E.Pitts,a son,all of whom were of legal age;that upon the death of the said Laura L. <br />Pitts the real estate hereinbefore described passed and descended by operation of the Intes- <br />tate Laws of the State of Nebraska,as follows:To Murray G. Pitts,Olive L. Syfert,Charles D. Pitts <br />and Almon E.Pitts,each an undivided one- fourth interest therein,as t enan-£s in common in <br />absolute title. <br />The Court further finds that the said Laura L.Pitts left a personal estate <br />sufficient to pay her funeral expenses and debts and such funeral expenses and debts have been <br />fully paid;that if any debts existed against the Estate of Laura L.Pitts,such debts are now <br />long since barred and precluded by the Statute of Limitation and are now forever barred and <br />precluded and the Court further finds that the costs of this proceeding has been paid in full. <br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED that the said Laura L.Pitts departed this life <br />at Columbus,Franklin County,Ohio;that she died on the first day of May21900;that at the time <br />of her death, she was a, resident and inhabitant of Columbus,Ohio; that more than 25 years have <br />lapsed since the death of the said Laura L.Pitts ;that no administration ha.s ever been had or <br />applied for upon her estate in the State of Nebraska;that the said Laura L.Pitts died seized <br />as the owner in fee simple title to Lots Ten (10) and Twelve (12) in Block Eighteen (19) <br />in College Addition to West Lawn in the City of Grand Island, Nebraska; that she left surviving <br />
