<br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA.
<br />IN THE MATTER OF THE ESTATE
<br />OF DECREE.
<br />ELIZA KENNEDY,DECEASED.
<br />Now on this 14th day of October,1924,this cause came on for hearing upon the petition of
<br />Richard K. liarrison,heretofore filed herein,praying that the Court determine and find: :the
<br />date of the death of the said Eliza Kennedy, deceased, that the said Eliza Kennedy,,died intestate,
<br />that the heirs at law of the said Eliza Kennedy be determined by the Court,and their respective
<br />degree of kinship fixed,and that tlxe right of descent of the real estate of the said Eliza
<br />Kennedy,deceased,be determined,and it appearing to the Court,from the proofs on file,that due'
<br />and legal notice,by publication,has been given as by and the order of this Court required,
<br />to all creditors,heirs and persons interested in the Estate of said deceased,of the time of
<br />the filing of said petition,and of the time and place fixed for the hearing thereon,whioh tinlj,
<br />was for more than thirty days and less than sixty days after the filing of said petition,and
<br />there being no objections thereto,said cause was duly admitted to the Court,upon the petition
<br />and the evidence produced by the petitioner in support thereof,and the Court being fully ads
<br />wised in the premises finds that the said Eliza Kennedy died intestate in grand Island,H411
<br />County,Nebraska,and that at the time of her death,the said Eliza Kennedy was a resident and
<br />inhabitant of the City of Grand Island,Hall County, Nebraska; that the said Eliza Kennedy died
<br />seized of an estate of- inheritance in real estate,located in Hall County, Nebraska, consisting
<br />of the ownership in fee simple of the North Half of the Southwest Quarter of Section 24,Town
<br />ship 11,North,Range ll,West of the 6th P. M. in Hall County,Nebraska; that more than fifty years
<br />have lapsed since the death of the said Eliza Kennedy,and that no application has ever been
<br />made in the State of Nebraska,for the appointment of an administrator of his estate,nor has
<br />administration upon the estate of the said Eliza Kennedy,deceased,ever been had in the State
<br />of Nebraska; that the petitioner herein is now the owner of said premises by purchase,and is a`
<br />competent and proper person to institute and prosecute this proceeding. .
<br />The Court further finds that the said Eliza Kennedy left surviving her,James Kennedy,a son,
<br />Robert Kennedy,a son and Edward Kennedy,a son,all of legal age; that upon the death of the said
<br />Eliza Kennedy,under the laws of the State of Nebraska,then in foroe,the real estate hereinbefore
<br />described passed and descended in equal shares to the said James Kennedy,Robert Kennedy and
<br />Edward Kennedy,one -third to each,as tenants in common,in absolute title.
