<br />all claims filed against said Estate hate been paid and satisfied,and that any claims not so
<br />filed,if any such there be,be and the same are hereby forever barred and excluded.
<br />The Court further finds that Joseph Henry. Sutton, departed this life on the lgth. day of
<br />July,1925 while a resident and inhabitant of Hall County, Nebraska, leaving a last will and
<br />t estament,which was duly admitted to probate and recorded in this Court on the 22nd day of
<br />August,1925. That Homer Loucks was nominated in said last will and testament as executor
<br />thereof,and that the following persons are the heirs at law of said Joseph Henry Sutton,de-
<br />ceased, to -wit:
<br />Alva Sutton,Ma.rtha Sutton,Erel ine E. Stevenson,Catharine Fitz<simmons,Minnie Kelly,George
<br />Sutton,James Edward Sutton,John Sutton,and Mary Foley,brothers and sisters ;and Emma Sutton,
<br />Hannah E.Sutton,Mina Sutton,Vinna Sutton,Lotta Sutton,Georgia Sutton,Frank Sutton and Ida
<br />Sutton,chbldren of William Sutton,a deceased brother;Mary Siefken,Hannah Siefken,frank Siefki
<br />Thomas Siefkin and Olver Siefkin,children of Jane H. Siefkin,a deceased- sister; Lottie Sutton,
<br />Ben Sutton,and Floyd Sutton,children of Oliver Sutton,a deceased brother ;Joseph Sutton,Mary
<br />Sutton,John Sutton,Frank Sutton,George Sutton,Eva Sutton,Thressie Sutton,Irene Sutton,Cecelia
<br />Sutton,Lorence Sutton,and Thomas Sutton;Jr.,ohildren of Thomas Sutton,a deceased brother.
<br />The court further finds that said Joseph Henry Sutton was the owner in fee simple of the
<br />Northwest Quarter of the Northeast Quarter (NW+ NE +) of Section Thirty -four (34)_ Township
<br />Nine (9) North,Range Nine (9),West of the 60 P.M. Hall County,Nebraska;and that he was poss-
<br />essed of personal property amounting to $1050.15,of which sum $359.35 remains.
<br />The Court further finds that according to the provisions of said last will and testament
<br />of the said Joseph henry Sutton,deceased,all of the said property both real and personal
<br />descended as follows to-wit
<br />To Alva Sutton and Martha Sutton,also known as Martha Ann Sutton,as joint tenants,for and
<br />during their natural life,and upon the death' of the survivorsof Alva Sutton and Martha Sutton,
<br />to Ereline E.Stevenson,Catharine Eitzsimmons,Minnie Kelly,George Sutton,James Edward Sutton,
<br />John Sutton and Mary Foley,each an undivided one- eleventh (1 /11) part thereof;to
<br />Emma Sutton,Hanna E.Sutton,Mina Sutton,Vinna Sutton,Lotta Sutton,Georgia Sutton,Frank
<br />Sutton and Ida Sutton children of William Sutton deceased,eaoh an undivided one - eighty- eighth
<br />(1/99) part thereof,to
<br />Mary Siefken,Hannah Siefkin,Frank Stefkin,Thomas Siefkin and Oliver Siefkin, children of
<br />Jane H. Siefkin,Deoeased,each an undivided one - fifty -fifth (1/55) part thereof; to
<br />Lottie Sutton,Ben Sutton and Floyd Sutâ–ºn,children of Oliver Sutton,Deceased,each an un-
<br />divided on e-thi rty. third (1/33) part thereof; and to
<br />Joseph Sutton,Mary Sutton,John Sutton,Frank Sutton,George Sutton,Eva Sutton,Thressie Sut
<br />Irene Sutton,Cecelia Sutton,Lorence Sutton and Thomas Sutton,Jr.childres of Thomas Sutton,
<br />Deceased, each an undivided orie -one hundred twenty -first (1/121 part thereof,
<br />to have of to hold to them and their heirs forever,subject only to the life estate in favor
<br />of Alva Sutton and Martha Sutton.
<br />The Court further finds that said estate,or the interest of any of the heirs of said de-
<br />ceased,is not subject to an inheritance tax.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED,That the final report of the Executor be and
<br />the same hereby is allowed as and for his final accounting and the he be disoharged; that
<br />all claims filed against said estate have been paid and that any claims not so filed,if any
<br />such there be,be and the same are hereby forever barred and precluded; that said estate actor
<br />ing to the provisions of said last will and testament descended to the persons hereinbefore
<br />named in the proportion and manner as herein found,and the same is hereby awarded to them and
