<br />IN THE FATTER OF THE ESTATE

<br />ORDER ADMITTING WILL TO PROBATE.
<br />ELIZA A FITCH,DECEASED.
<br />Now on this 26th day of June,1924,this cause came on for hearing upon the 'dduly verified
<br />petition of Charles M. Redman ,heretofore filed,praying for the admission to probate of an
<br />instrument in writing,purporting to be the last will and testament of Eliza A.Fitch,deceased
<br />and codicil thereto,and it appearing to the satisfaction of the Court that notice as by law
<br />required was given to all persons interested in the estate of said deceased,by publication
<br />such notice for 3 successive weeks as required by law and by order of Court and that no one
<br />has appeared to object to or protest against the allowance of said purported will and codi
<br />thereto.
<br />WHEREUPON Albert R.Redman,one of the subscribing witnesses to said purported will and Jul
<br />Smith,one of the subscribing witnesses to said purported codicil to said will were sworn and
<br />examined and their testimony was reduced to writing and filed in this Court.
<br />ON CONSIDERATION of the files in this matter and of all of the testimony the Court finds
<br />that the said Eliza A. Fitch departed this life on the 10th day of Hay,1924,being at the time
<br />of her death a resident of Hall County,Nebraska,and that she left a last will and testament,
<br />with codicil thereto,whioh will and codicil were duly executed as required by law;that the
<br />testatrix at the time of making said will and codicil thereto,was of full age,of sound mind
<br />and memory and not under restraint and was in all things competent of devise real and person
<br />estate,and that said will and codicil thereto,have been duly proven and should be allowed,
<br />as and for the last will and testament of the said Eliza A. Fitch,deoeased.
<br />IT IS THEREFORE CONSIDERED BY THE COURT that said last will and testament and the codicill
<br />thereto were duly executed,that the same are genuine and valid and have been duly proven ands
<br />that said last will and testament and codicil thereto be allowed,admitted to probate,estab_
<br />lis4ed as a will of real and personal estate and entered of record in this office.
<br />IT IS ORDERED that Letters Testamentary be issued thereon to Charles M.Redman,of Doniphan,
<br />Nebraska,who is nominated in said last will and testament to be the executor thereof upon hi
<br />filing in this Court his bond in the sum of $25000.00 with surety to be approved by the C
<br />IT IS ORDERED that said Executor be allowed one year in which to administer the estate of
<br />said deceas- ed,and make settlement with the legatees under the will and with the Court.
<br />IT IS ORDERED THAT Creditors of the said Eliza A.Fitch,deeeased,be allowed 3 months from
<br />and after the 29th day of July,1924,in which to file their claims in the offices of the Count3
<br />Judge of Hall County,Nebraska,for allowance,and that all claims outstanding against said
<br />estate not so filed and within the time here limited shall be forever barred and excluded.
<br />IT IS ORDERED that a hearing on claims filed against the estate of said Eliza A. Fitch,de-
<br />ceased,be had at this office on the 29th day of October,1924,,at 9 o'clock A.H.
<br />FINALLY IT IS ORDERED that notice of the time allowed for filing claims against the esta-
<br />of said deceased,and of the place appointed for filing such claims and of the time fixed for
<br />the. hearing on claims filed against said estate,be given to all creditors of said deceased,
<br />by publication of such notice for 4 successive weeks in the GRAND ISLAND INDEPENDENT,a semi.
<br />weekly newspaper published and circulating in Hall County,Nebraska,
<br />J. H. Mullin ,County Judge.
