In the matter of the estate of �! Emma Yon Wasmer, FINAL DECREE. Deceased. Now,on this 26th day of April,A.D. ,1924,this cause came on for hearing upon the final_ report of henry J.Bartenbach,as executor of the last will and testament of Emma Yon Wasmer, deceased,and upon his petition for the settlement of said estate and his dischargeherein, and the Court,having examined the records and files and being fully advised in the premises, finds that due and legal notice has been given to all persons interested in said estate of the time and place fixed for hearing upon said report,as heretofore ordered by the Court, and the Court,having examined said report and no one appearing to object to the same,finds t said report is true and correct in all things and that the same ought to be allowed and apps as and for the final report of said Executor. The Court further finds that due and legal notice has been given to all persons interest in said estate of the time and place fixed for the filing of claims against said estate,and that the time so fixed has fully expired,and that all persons having claims against said es— s it tate,if any such there be,are forever barred and excluded from setting up or asserting any soh claims against said estate. The Court further finds that the funeral expenses of said deceased have been fully paid,as� well as the costs of this proceeding,and that said Executor has fully accounted for all of sa d estate and that the same ought to be settled and closed and said Executor discharged. The Court further finds that the said Emma Yon Wasmer died seized as the owner,in fee si ple title,of the northerly half of Lot Six (6),in Block Twenty -eight (29),in Charles Wasmer's Addition to the city of Grand Island,in Hall County,Nebraska,and that the value thereof does iot exceed the sum of two thousand dollars,and that under the terms and provisions of the last will and testament of the said Emma Yon Wasmer,deoeased,heretofore proves,allowed and admitte to probate in this Court,the title to said real estate passes to Henry J.Bertenbach,as trusts , in trust,upon the uses and trusts and for the purposes following; To receive,hold,invest,and from time to time re- invest the same,for the use and benefit of Maggie Yon Wasmer,a daughter if said deceased,and to use the income therefrom,and so much of the principal thereof as may be neces for the comfortable support of the said Maggie Von Wasmer during her lifetime,and should any of said trust estate remain at the death of the said Maggie Von Wasmer,to deliver the same to Christian Von Wasmer,the husband of said deceased,in the event he is then alive,and in the event the said Christian Yon Wasmer is then dead,to turn the same over 10 Herman Yon Wasmer aad Elfrieda Bartenbach, son and daughter of said deceased, share and share alike,the right bei reserved in said trustee,and his successor in trust,to sell and convey the aforesaid real a st and in the event of the death of the said Henry J.
