<br />September 17,1924,petition verified and filed by Hattie K.Corrigan and Emil Kluck,reciting
<br />that Johanna Kluck died September 12,1924,testate,being at and immediately prior to her dear -
<br />th a resident and inhhbitant of Colfax County,Nebraska,possessed of real and personal estate
<br />in the State of Nebraska,and that the names,ages and places of residence of her heirs at law
<br />and other persons interested in said estate are as follows:

<br />Lillie Gaeth,age 50 years,Schuyler,Nebrska,Daughter
<br />Le-mis Kluck,age 47 years,Tuttle,Oklahoma,Son

<br />Jessie Eberhart,age42 yea .rs,Schuyler,Nebraska,Daughter
<br />Henry Kluck,age 41 years,Oklahoma City,Okla.,Son

<br />Prayer for probate of Will and appointment of Executors.
<br />September 17,1924,order of Coiz t entered assigning October 16,1924,in the County Court
<br />room as the time and placeof hearing said petition,and directing that notice thereof be
<br />ii
<br />° given to all persons interested by publication in the Schuyler Sun,three successive weeks
<br />prior to said day of hearing.
<br />October 17,1924,affidatit of F. L. Carroll filed reciting that he is President of the Sun
<br />Publishing Company,publishers of-the Schuyler Sun,that said newspaper is of general circula-
<br />tion in said County,has at least 300 bona fide subscribers and has been published in said
<br />County and State more than 52 consecutive weeks immediately prior to the making of this aff-
<br />idavit,and that the notice,as per copy attached to affidavit,was published in said newspaper
<br />three consecutive weeks,in the tasues of September 18,25,October 2,1924.
<br />Notice recites the filing of a petition and an instrument purporting to be the last Will,
<br />and Testament of Johanna Kluck,and recites the prayer of the petition,and notifies -all per-
<br />sons that the petition and proof of executing said Will will be heard October 16 1924.
<br />October 16,1924,decree of probate entered,proving and allowing the instrument filed as
<br />the last Will and Testament of Johanna K1uck,Deceased,and appointing Emil Kluck and Hattie
<br />K. Corrigan as executors thereof upon their filing bond rith approved surities in the sum of
<br />$30,000. 00.
<br />Will as probated is as follows;
<br />"Be it remembered that I,Johanna Kluck of Schuyler,Colfax Count y,Nebra.ska,being of sound
<br />j
<br />mind and memory but knowing the uncertainty of this life,do make this my last Will and Testa- '!
<br />ment,hereby revoking all wills heretofore made b'y me,
<br />First.
<br />After payment of my just debts and funeral charges,I direct that the sum of One Thousand
<br />Dollars ($1,000.00) be set aside and used for the purpose of erecting a suitable monument and
<br />providing for perpetual care of aemetery lot in which my remains are place.
<br />Second.
<br />;ive,devise and bequeath to my son,Emil Kluck the sum of Six Hundred Dollars ($600.00).
<br />Third.
<br />;ive,devise and bequeath all of the rest,residue and remainder of my estate,real and
<br />zal and mixed wh -eresoever found and situated to my sons,namely,Henry K1uck,Albert J.
