<br />The Court further finds that said Charles Niemoth left surviving him,as his sole and onlyt
<br />heirs at law,his widow,Abeline Niemoth,his brothers,George F.Niemoth,and Adolph Niemoth,and s
<br />Marie Niemoth,the sole survivor and heir at law of Albert Niemoth;the said Albert Niemoth

<br />was a brother of said Charles Niemoth,deceased,and preceded said Charles Niemoth in death,
<br />i
<br />and left surviving him as his sole and only heir.at law his daughter,the said Marie Niemoth,
<br />a resident of Germany,and that the real estate,to- wit,Lot 52in Block 95,0riginal Town,now City,
<br />I
<br />of Grand Island,Hall County,Nebraska,was at the time of the death of said Charles Niemoth hid
<br />homestead,and that said real estate passed and descended,under the laws of descent of the state
<br />of Nebraska as follows:

<br />said Lot 5,in Block 95,Original Town,now City,of Grand Island,Hall County,Nebraska,passedl
<br />to Abeline Niemoth an.'. undivided one half interest and an undivided one half interest
<br />and descendelt:) George F.Niemoth,Marie Niemoth,and Adolph Niemoth,in equal shares, a

<br />subject.however,to a life estate ih the widow,Abeline

<br />Niemoth.
<br />The east half of the northwest quarter and the southwest quarter of the north -west quartet of
<br />Section Twenty -three (23),Township Twelve (12),North,Range Nine (9) West of the 6th P. M. ,in

<br />passed and descended to the widow,Abeline Niemoth,an undivided one -half interest,and to Geor�e
<br />F.Niemoth,Adolph Niemoth,and Marie Niemoth,an undivided one -sixth interest each.
<br />The Court further finds that said estate was not subject to inheritance tax under the lawO
<br />of the state of Nebraska,that said administrator has paid all the funeral expenses and debtsi'
<br />{
<br />of the deceased and costs of administering said estate and that said estate ought to be 01-os6d
<br />and the administrator discharged.
<br />The Court further finds that the household furniture and wearing apparel halve been delivered
<br />to the widow,Abeline Niemoth,as by law provt,ded.
<br />The Court further finds That due and legal notice has been given to all persons of the tim;
<br />and place fixed for filing claims against the estate of Charles Niemoth,deceased,and that the
<br />time so fixed has fully expired,and that all persons having claims against said estate of
<br />Charles Niemoth,deceased,if any such there be,and -not filed herein,are forever barred and ex
<br />eluded from setting up or asserting any such claims against said °estate.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED that the final report of said William Suhr,
<br />Administrator of the estate of Charles Niemoth,deceased,be,and the same is hereby approved
<br />and allowed as and for his final report,and said Administrator upon the filing of receipts
<br />from all the heirs at law,of said Charles Niemoth,deceased,be discharged and his bond re-
<br />leased and said estate is hereby settled and closed.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all persons having claims
<br />against the estate of Charles Niemoth,deceased,if any such there be,are forever barred,en-
<br />joined,and precluded from setting up or asserting such claims against said estate.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED that the real estate hereinafter described
<br />passed and descended under the laws of descent of the state of Nebraska as follows:

<br />Lot 5,in Block 95,in Original Town,now City,of Grand Island,Hali County,Nebraska,passed
<br />to Abeline N' emoth an undivided one half interest and an undivided one half interest
