nQ AND DECREE <br />LAST WILL AND TESTAMENT OF CHARLES H.BOLDT. <br />I Elf <br />I,Cherles H.Boldt,of Grand Island,Hall C016nty,Nebraska,bed)ng of sound and disposing mind <br />and memory and considering the uncertainty of this mortal life,do hereby make,publish and de- <br />Clare this as and for my last will and testament that is to say: <br />First. <br />I direct that all of my just debts,including funeral expenses and the expenses of my last <br />sickness be paid out of my personal property as soon after my decease as conveniently may be. <br />Second. <br />I give devise and bequeath unto my beloved wife,Augusta Boldt,all of my real estate to have <br />and to hold for and during %her natural life,with remainder over as hereinafter provided;the <br />intention being to give my wife the use,benefit and income of my real estate as long as she may <br />live and after her death the devises hereinafter provided are to take effect. <br />I further give and. bequeath unto my said wife all of my personal property,except livestock, <br />farm machinery and such other personal property as is on the farm hereinafter devised to my son <br />Arthur and used for farming pi=poses,to have and to hold forever and absolutely. <br />Third. <br />I give,devise and bequeath unto my son,Arthur Boldt,the south one -hald of the southeast <br />one- fourth and the south one -half of the south -west one- fourth of Section Twenty- five,Township <br />Twelve,Range Eleven West of the 6th P. M. Hall County,Nebraska,to have and to hold to him and his <br />heirs forever,subject,however,to the aforesaid life estate in my wif e,and further subject to a <br />charge of Six Thousand Dollars to be paid as hereinafter provided to my daughter Martha Rauert <br />and my son Richard Boldt. The aforesaid charge of Six Thousand Dollars is to be f.`fitst and best <br />lien upon the said real estate and my son Arthur shall be required to pay the same before title <br />thereto shall vest in him. I further give and bequeath unto my son Arthur all of the livestock, <br />farm machinery and other personal property used for farming purposes in my possession and on my <br />said farm at the time of my death to have and to hold forever. <br />Fourth. <br />I give and bequeath unto my daughter,Martha Rauert,the sum of Three Thousand Dollars to be <br />paid her immediately upon the death of my wife,if she survive me,other wise upon my death,by <br />my son Arthur out of the farm heretofore devised to him. This bequest being one -half of the <br />amount charged against the devise to my son Arthur in paragraph ",Three" of this will. This sum <br />is to be paid my said daughter before title to said real estate is to vest in my said son. I <br />give and bequeath this said amount to my said daughter absolutely and forever. <br />Fi f th. <br />Whereas,my said son,Richard Boldt,is indebted to me on a promissory note in the sum of Three <br />Thousand Dollars an d,whereas,the afore described real estate is mortgaged in said amount by me <br />for the purpose of making this advance to mtr said son Richard Boldt,I therefore,give:, devise and <br />bequeath unto my son Richard the sum of Three Thousand Dollars to be paid him immediately upon <br />the death of my wife,if she survive me,otherwise upon my death,by my son Arthur out of the real <br />estate heretofore devised to him,this bequest being one -half of the amount charged against the <br />devise to my son Arthur in paragraph "Three" of this will,and shall be and constitute a first <br />and best lien together with the bequest to my daughter Martha,upon said real estate,to have and <br />to hold absolutely and forever,provided,however,that if my son Richard,at the time of my death, <br />or at tide time of the death of my wif e, if she survive me, shall have failed,refused or neglected <br />to pay the aforesaid note and mortgage by which said real estate hereinbefore described is en- <br />cumbered in the amount of Three Thousand Dollars,then the aforesaid bequest to him in the amount <br />of Three Thousand Dollars,shall fail,and my son Richard shall in lieu thereof keep the money <br />1 <br />1 <br />1 <br />1 <br />1 <br />
