<br />approved and allowed as and for
<br />the final report of said Executrix,said estate settled and closed
<br />and said executrix discharged.
<br />The Court further finds that
<br />due and legal notice has been given to all persons of the time
<br />and place fixed by the Court for
<br />filing claims against said estate,and that the time
<br />so fixed
<br />has fully expired,and that all persons having claims against said estate,if any such
<br />there be,
<br />are forever barred and excluded
<br />from setting up or asserting any such claims against
<br />said estate.
<br />The Court further finds that
<br />said executrix has paid the funeral expenses of said
<br />deceased,
<br />the costs of this proceeding,all bequests contained in the last will and testament of the said
<br />Samuel 4cClurkin,Sr.,deceased,and that nothing father remains in her hands belonging to said
<br />estate,and that said estate is not subject to a Federal estate tax or to an inheritance tax under
<br />the laws of the state of Nebraska.
<br />The Court further finds that the said Samuel McClurkin,Sr, died seized as the owner,by fee
<br />simple title,of the north half of the southeast quarter of Section Thirty (30,the north half of
<br />the northeast quarter of Section Thirty -one (31),and the east half of the northwest quarter of
<br />Section Thirty -two (32),all in Township Eleven (11) North,Range Twelve (12) vNest,in Hall County,
<br />Nebra.ska,and. that under the terms and provisions of the last will and testament of said Samuel
<br />Mcelurkin,Sr. ,Elizabeth McClurkin, surviving widow of said Samuel McClurkin, Sr. ,takes a life es-
<br />tate in all of the above described real estate,and that the remainder over in said real estate
<br />passes,by absolute title,to Ida. Pday Houtsinger,Samuel G. McClurkin,a.nd Thomas J. McClurkin,share
<br />and share alike,without power in the said Elizabeth McClurkin,Ida May Houtsinger,Samuel G.Mc-
<br />Clutkin,and Thomas J.',UcClurkin,or either of them,to mortgage said real estate during the life-
<br />time of the said Elizabeth McClurkip.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of the said
<br />Elizabeth McClurkin,as executrix of the last will and testament of said Samuel McClurkin,Sr.,
<br />deceased,be,and the same hereby is,approved and allowed as and for the final report of said
<br />executrix,said estate is hereby settled and closed,and said executrix discharged.
<br />IT IS FURTHER ORDER"D,ADJUDGED AND DECREED BY THE COURT that all persons having claims against
<br />said estate,if any such there be,are forever barred,and excluded from setting up or asserting
<br />any such claims against said estate,
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under the terms and provisions
<br />of the last will and testament of the said Samuel McClurkin ,Sr.,deceased,Elizabeth McClurkin,
<br />his surviving widow,takes a life estate in all of the real estate hereinbefore described,and,
<br />subject only to the life estate of the said Elizabeth McClurkin,said real estate passeg,by ab-
<br />solute title,to Ida May Houtsinger,Samuel G.McClurkin,and Thomas J.McClu:kkin,children of said
<br />deceased,share and share alike,without power in the said Elizabeth McClurkin,Ida May Houtsinger4
<br />Samuel G.McClurkin,and Thomas J.McClurkin,or either of them,to incumber said premises by mortgage
<br />during the lifetime of the said Elizabeth McOlurkin,and distribution of said real estate is
<br />hereby accordingly made.
