<br />I,James Lee,of Newton,Jasper County,Iowa,being of sound and disposing mind and memory do
<br />make,publish and declare this to be my last will and testament,hereby revoking any and all former
<br />wills by me at any time made.
<br />FIRST: I give,devise and bequeath to my son,Chaucer $. Lee,of Ames,Iowa,the
<br />Northwest one- quarter (NWJ) m dnd the South one -half (Sj) of the North -east one - quarter (NZJ)
<br />of Section No.27,in Township No 11 North,Range 12 West in Hall County,Nebraska.
<br />SECOND: I give devise and bequeath to my daughtertMary Etta Rose,of Grand Island, Nebraska. the
<br />Southoasir one- quarter (SE +) of Section 27,in Township 11 North,Range 12 Westin Hall County,
<br />Nebraska. _
<br />THIRD: I hereby give,devise and bequeath the sum of Forty Thousand Dollars ($40,000.00) in trust
<br />to Chaucer G.Lee,of Ames,Iowa,and to Morton L.Rose,of Grand Island,Nebraska,to beheld in trust
<br />for the following uses and purposes in relation to the same:
<br />Said trustees are to hold,invest,re- invest,and in all respects generally handle,manage and oper-
<br />ate the said trust estate is such securities,properties or investments as they may deem most
<br />advisable,and they are vested with the sole discretion and power to determine what shall con-
<br />stitute the principal of the trust estate or net income available for distribution under the
<br />terms of this trust.
<br />Said trustees are to hold said trust fund during the term of the natural life of my daughter,
<br />Orpha Fantle Daly,of Newton,Iowa,and from the income received or derived from the trust estate
<br />there shall first be paid and discharged all taxes,costs and charges incurred in the care
<br />of the trust estate,including a compensation for the trustees of a sum not to exceed one -half
<br />of one per cent of the principal sum of said trust fund,and the entire net income received or
<br />derived from the trust estate shall,at least semi- annually,go and be paid to my daughter
<br />Orpha Fantle Daly,during her life.
<br />Wpon and at the time of the death of said Orpha Fantle Daly this trust shall cease and the
<br />entire trust estate shall go and be by said trustees.eonveyed,transfemred and delivered in fee
<br />to my son,Chaotr GAse,of Ames,Iowa,and to my daughter.Mary Etta Rose,of Grand Island,Nebraska,
<br />in equal portions,share and share alike,and if at the time of distribution either of said
<br />parties shall have died,then the share or portion which wogld have gone to said deceased child
<br />shall go to and be distributed to his or her heirs. The said Chaucer G.Lee and Morton L.Rose
<br />named herein as trustees v e totaot without being required to give bond.
<br />FOURTH: I hereby give,devise and bequeath the sum of Two Thousand Dollars ($2000.00) to Chaucer
<br />G. Lee and Morton L. Rose to be held by them in trust for the following purposes and uses in re=
<br />lation to the same;
<br />Said Two Thousand Dollars ($2000.00) is to be held by them,invested and re- invested during
<br />the life time of my son,James E.Lee,who is now confined in a hospital at Mt.Pleasant,Iawa,and
