That <br />on the 18th day of October 1924,said instrument to which this certificate is attached was duly <br />proved,probated and allowed as the last will and testament of the real and personal estate of <br />said Patrick Finan,deceased,and the same was ordered to be recorded in the records of the Court' <br />aforesaid. <br />IN WITNESS ITHEREOF I have hereunto set my hand and affixed the seal of the County Court this <br />l8th day of October 1924. <br />( SEAL) <br />J. Finan, FINAL DECREE. <br />Deceased. <br />Now,on this 8th day of August,1925,this cause came on for <br />hearing upon the final report of Andrew P.Finan and Catherine A.Finan,executrices of the last <br />will and testament of Patrick Finan,deeeased,and upon their petition for the settlement of said <br />estate and their discharge herein,and the Court having examined the records and files and being <br />fully advised in the premises finds that due and legal notice has been given to all persons of he <br />time and place fixed for a hearing upon said final report,as heretofore ordered by the Court, <br />no one appearing to object to said report,and the Court having examined the same,find s that <br />S <br />said report is true and correct in all things and that the same ought to be approved and allowed <br />as and for the final report of said executrices,sai d estate settled and closed and said executrices <br />G <br />discharged. <br />The Court further finds that due and legal notice has been given to all persons of the time <br />and place fixed by the Court for filing claims against said estate,and that the same has fully <br />expired,and that all persons having claims against said estate,if any such there be,are forever <br />barred and excluded from setting up or asserting any such claims against said estate. <br />The Court further finds that said Executrices have paid the funeral expenses of said deceased, <br />the debts of said estate,t4e costs of this proceeding,and have paid over to Catherine A.Finan and <br />Nellie F.Finan,residuary legatees,the balance of the personal estate remaining in their hands, d <br />the Court further finds that the estate of the said Patrick Finan was not subject to an inheritF <br />tax under the laws of the state of Nebraska or to a Federal estate tax under the laws of the <br />United States. <br />The Court further finds that John J.Finan a son of the said Patrick Finan,deceased,and named <br />as one of the legatees in the third and fourth paragraphs of the last will and testament of the <br />said Patrick Finan,deceased,departed this life on March 4,1923,1ong prior to the death of the s�id <br />Patrick Finan;that said John J.Finan was never married,and that by reason of the death of the ss�d <br />John J.Finan prior to the death of the said Patrick Finan,the legacies in his favor in the third <br />and fourth paragraphh of the last will and testament of the said Patrick Finan,deceased,lapsed, <br />and in no manner became a lien upon the real estate mentioned and described in the third and <br />fourth paragraphs of the last will and testament'of the said Patrick Finan,deceased. <br />The Court further finds that the said Patrick Finan died seized as the owner,by fee simple <br />title,of the following described real estate situated in the county of Hall and state of Nebrask <br />to_wit: the southeast quarter of the southeast quarter of Section Sixteen (16),in Township Ten <br />(10) North,Range Eleven (11) West,in Hall County,Nebraska,and that by the terms of his last will <br />and testament the above described real estate,upon the death of the said Patrick Finan,passed, <br />by absolute title,to Andrew P.Finan,a son of said deceased,charged,however,with the payment <br />to Frances M.Ha.rdy,Mary A. Hewitt,Bridget L. Finan,and Alice E.
