<br />Thaddus L.Trout left surviving him,as his heirs at law and his sole and only heirs at law,hib
<br />surviving widow,Alice Trout,an d a minor.san,Richard H.Trout,who become entitled,share and share
<br />alike,to the $250 bequest in the last will and testament of Abraham Trout,deceased,in favor of
<br />the said Thaddus L.Trout.
<br />The Court further finds that the said Abraham Trout left suviving him,as his heirs at law,
<br />legatees,and devisees,and his only heirs at law,legatees,and devisees,the following named per-
<br />sons: Mary Ann, Trout,surviving widow of said deceased,and mother of all his children;Herbert
<br />E.Trout,a son,Thaddus L.Trout,a son,Lula Z.Trout,now Lula Z.Rouse,a daughter,Frank L.Trout,a
<br />son,Edward W.Trout,a son,Walter A.Tro'ut,a son,Jennette Hughes,a daughter,and Sarah Milisen,
<br />a daughter.
<br />The Court further finds that said Executor has paid all debts against said estate,the funeral
<br />expenses of said deceased,the special legacies provided for in the last will and testament of
<br />said deceased,and the costs of this proceeding,and that nothing further remains in his hands.
<br />The Court further finds that said Abraham Trout,deceased,died seized as the owner by fee
<br />simple title of the following described real estate situated in the county of Hall and state of
<br />Nebraska:The southeast quarter of the southeast quarter of Section Thirty -six (36),in Township
<br />Twelve (12) North of Range Ten (10) West,the south half of Lot Two (2),in Section Thirty -one
<br />(31) in Township Twelve (12) North,Range Nine (9) West,and Lot One (1) in Section Six (6) in
<br />Township Eleven (11) North,Range Nine (9) West.
<br />The Court further finds that under the terms and provisions of the last will and testament of
<br />the said Abraham Trout,deceased,the real estate above described passed,by absolute title,as
<br />follows, An undivided one -third to Mary Ann Trout,surviving widow of said deceased,and an
<br />undivided one- twelfth each to Herbert E'. Trout,Thaddeus L. Trout, Lula Z. Trout,now Lula Z. Rouse,
<br />Frank L.Trout,Edward W.Trout,Walter A.Trout,Jennette Hughes,and Sarah Milisen,sons and daughters
<br />of said deceased.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of the said
<br />Edward W. Trout,as sole surviving executor of the last will and testament of the said Abraham
<br />Trout, deceased,bp, and the same hereby is,approved and allowed as and for his final report,said
<br />estate is hereby settled and closed and said Executor discharged.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all persons having claims against
<br />the estate of the said Abraham Trout, deceased, if any such there be,are forever barred,excluded
<br />and enjoined from setting up or asserting any such claims against said estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under the terms and provisions
<br />of - the last will and testament of the said Abraham Trout, deceased, the title to the real estate
<br />hereinbefore described passed as follows: To Mary Ann Trout,surviving widow of said deceased,
<br />an undivided one - third,and an undivided one - twelfth each to Herbert E. Trout,Thaddeus L.Trout,
<br />Lula Z. Trout,now Lula Z. Rouse,Frank L. Trout,Edward W. Trout,Walter A. Trout, Jennette Hughes,and
<br />Sarah Milisen,sons and daughters of said deceased,and distribution thereof is hereby accordingly
<br />made.
