Triggs was a resident and i- rhabitar_t of the county of Hall in the state <br />of Nebraska;that more than two years have elapsed since the death of said deceased,and that no <br />application or petition has ever been filed in the state of Nebraska forthe appointment. of an <br />administrator of her estate: and no administration of her estate ha.s ever been had; that said <br />Nancy J. Triggs left surviving her,as her heirs at later and her only heirs at law and next of kin, <br />the following named persons: George T7. Triggs, the petitioner herein, surviving husband of said de- <br />ceased,and father .f all of the children of said deceased; John F. Triggs,a. son,of lawful age, <br />Carrie Schlund,a daughter,of lawful age,and Myrtle Trigbs,a daughter,of lawful age;that said <br />Nancy J.Triggs,died seized as the owner by fee simple title of the following described real <br />estate situated in the county of Hall and State of Nebra.ska,to -wit: Lot Seven (7) in Block One <br />Hundred Twenty -two (122) of Union pacific Railroad Company's Second Addition to the city of <br />Grand Island,gs surveyed,platted,and recorded,a.nd that upon the death of the said Nancy J.Triggs <br />theneal estate above described passed and descended,uncler the intestate laws of the state of <br />Nebraska then in force,as follows: An undivided one -third to George ?R. Triggs,a surviving husband <br />of said deceased,and an undivided taro— ninths each to said John F.Triggs,Ca.rrie Schlund,and 'my- <br />rtle Triggs,son and daughters of said deceased;that said George 'V.Triggs was at the time of <br />filing the petition herein the owner of an undivided one -third of said real estate and was a <br />competent and proper lberson to prosecute this proceeding; that the funeral expenses of said <br />deceased and the debts of said deceased and the costs of this proceeding have been fully paid, <br />and. if any debts exist against ^,aid estate,the same have long since been barred by the Statutes <br />of Limit:r,tions of the state of Nebraska,and that the petitioner herein is entitled to a decree <br />as prayed in said petition. <br />IT IS, THE REFORE, ORDERED ,ADJUDGE%; AND DECREED BY THE COURT,tha.t the said Nancy J.Triggs,dep- <br />arced this life,intestate,on the 16th day of February,lg23,and at the tine of her death the said <br />Nancy J.
