Now on this 24th day of May,1924,this cause cameon for hearing upon the final report of Charle J. McCullough, executor of the Last Will and Testament of Ellen McCullough,deceased,and it appearing to the satisfaction of the court from the proof no on file that notice as required by law and by order of court has been given to all persons inter-. ested by publication in -.' the WOOD RIPER SUNBEAM,a weekly newspaper. On examination of said report the court finds that the same is correct ifi all respects and ought to be allowed as and for the final account of said executor;that said executor has accounted for all of the estate of said deceased which came to'his possession or under his control and that there remains no money or other personal property in his hands for distribu- tion. The court finds that notice as required by law seas given to all creditors of said deceased as to the time limited and place appointed for filing claims against said estate and that the time allowed for filing claims has fully expired;that all claims outstanding against said es- -ra *e not filed within the time limited for filing claims are,therefore forever barred and ex- cluded;that all claims filed and allowed against said estate have been paid and satisfied. It is,therefore,considered by the court that the report of said executor be and the same hereby is approved and allowed as and for his final account. It is further considered by the court that all persons are forever barred,excluded and precluded from filing or setting up any arlaims or demand against the estate of Ellen McCullough) deceased. The court finds that the said Ellen McCullough departed this life on the 11th day of July, 1923,that she was at the time of her death a resident and inhabitant of Hall County,Nebraska, and that she left a last will and testament which instrument was duly proved,allowed and ad- mitted to probate in this court on the 29th day of September,1923,and recorded in this office. The court finds that the said Ellen McCullough was at the time of her death the owner in fee of the following described real estate situate in the clunty of Hall and state of Nebraska, to -wit: The West half of the south west quarter (W-,'F of s.W. j) of Section Twenty (20) in Town- ship Eleven (11),North,in Range Ten (10),west of the 6th P.M. The court finds that under and by virtue of the provisions of said last will and testament the above mentioned and described real estate did pass and descend at the death of the said Ellen McCullough in the manner following: To Peter McCullough,her husband,for the term of his natural life,he to have the use and rentals of said real estate with the provision and injunction,however,that the said Peter McCullough furnish to Anna Searson,sister of the testatrix,a comfortable home on said premises as long as she may live. The court further finds that it was the will of the testatrix that Charles J.McCullough farm said real estate and that he pay to his father for the use thereof one third of the crops produced therefrom. The court further finds that under the terms and provisions of said Last Will and Testament said real estate as above described passes at the death of the said Peter McCullough to Charles J.McCullough subject,however,to the payment by him of the following bequests: To Thomas A. McCullough, To Albert W. McCullough, To Mary E. Butler, To John E. McCullough To Bryan T.MeCullough, To Floyd S.McCullough, $300.00, 300.00 , 300.00 , 300. 00 , 300.00 , and 300.00.
