McCullough, executor of the Last Will and Testament of Ellen <br />McCullough,deceased,and it appearing to the satisfaction of the court from the proof no on <br />file that notice as required by law and by order of court has been given to all persons inter-. <br />ested by publication in -.' the WOOD RIPER SUNBEAM,a weekly newspaper. <br />On examination of said report the court finds that the same is correct ifi all respects <br />and ought to be allowed as and for the final account of said executor;that said executor has <br />accounted for all of the estate of said deceased which came to'his possession or under his <br />control and that there remains no money or other personal property in his hands for distribu- <br />tion. <br />The court finds that notice as required by law seas given to all creditors of said deceased <br />as to the time limited and place appointed for filing claims against said estate and that the <br />time allowed for filing claims has fully expired;that all claims outstanding against said es- <br />-ra *e not filed within the time limited for filing claims are,therefore forever barred and ex- <br />cluded;that all claims filed and allowed against said estate have been paid and satisfied. <br />It is,therefore,considered by the court that the report of said executor be and the same <br />hereby is approved and allowed as and for his final account. <br />It is further considered by the court that all persons are forever barred,excluded and <br />precluded from filing or setting up any arlaims or demand against the estate of Ellen McCullough) <br />deceased. <br />The court finds that the said Ellen McCullough departed this life on the 11th day of July, <br />1923,that she was at the time of her death a resident and inhabitant of Hall County,Nebraska, <br />and that she left a last will and testament which instrument was duly proved,allowed and ad- <br />mitted to probate in this court on the 29th day of September,1923,and recorded in this office. <br />The court finds that the said Ellen McCullough was at the time of her death the owner in <br />fee of the following described real estate situate in the clunty of Hall and state of Nebraska, <br />to -wit: The West half of the south west quarter (W-,'F of s.W. j) of Section Twenty (20) in Town- <br />ship Eleven (11),North,in Range Ten (10),west of the 6th P.M. <br />The court finds that under and by virtue of the provisions of said last will and testament <br />the above mentioned and described real estate did pass and descend at the death of the said <br />Ellen McCullough in the manner following: <br />To Peter McCullough,her husband,for the term of his natural life,he to have the use and <br />rentals of said real estate with the provision and injunction,however,that the said Peter <br />McCullough furnish to Anna Searson,sister of the testatrix,a comfortable home on said premises <br />as long as she may live. <br />The court further finds that it was the will of the testatrix that Charles J.McCullough <br />farm said real estate and that he pay to his father for the use thereof one third of the crops <br />produced therefrom. <br />The court further finds that under the terms and provisions of said Last Will and Testament <br />said real estate as above described passes at the death of the said Peter McCullough to Charles <br />J.McCullough subject,however,to the payment by him of the following bequests: <br />To Thomas A. McCullough, <br />To Albert W. McCullough, <br />To Mary E. Butler, <br />To John E. McCullough <br />To Bryan T.MeCullough, <br />To Floyd S.McCullough, <br />$300.00, <br />300.00 , <br />300.00 , <br />300. 00 , <br />300.00 , and <br />300.00. <br />
