H. Mullin, <br />County Judge. <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA. <br />In the matter of the estate and <br />DECREE. <br />will of Joseph H. Smith,deceased. <br />Now on this 23rd day of Jan uary,1925,this cause came on for <br />hearing before the court upon the petition filed herein by Frances Smith,widow,and the court <br />being fully advised in the p remises,finds due and legal notice has been given to all persons <br />interested in the manner and form provided by law for three successive weeks,by publication <br />in the Grand Island Independent,a legal newspaper published and of general circulation in <br />Hall County,Nebraska,and that no objectionsha ve been filed thereto. <br />The court finds from the evidence adduced,that Joseph H.Smith died at Augusta,Hancock County,' <br />Illinois,on the 24th day of May,1922,a resident of said eo=- y and state,leaving a last will <br />and testament which was duly and regularly admitted to probate in said court on the 17th day <br />of July,1922,as the will of deceased,a duly authenticated copy of which has been filed in this <br />court. That the said Joseph H. Smith died seized of the title in f ee of the North East Quarter <br />of section Eight (S),in Township Ten (10),North,Range Twelve (12),West of the Sixth principal <br />meridian in Hall County,Nebraska,and that said instrument should be allowed as the last will <br />of deceased in this court. The court finds that the deceased left no issue,no father or mother. <br />That he left as his sole heirs at law,hid devises under his will,his widow,Frances Smith, <br />his brothers,Benjamin H.Smith,and John T.Smith,and his sisters,Harriett Ellis and Martha Moore, <br />and his nieces,Nannie M.Norton,Mar y Stoner and Minnie Joyner,and his nephew,Morris Emery <br />Moore,all of fall legal age,a.nd no others. That under t #e terms of the will of the deceased, <br />the widow,Frances H.Smith,takes an undivided one -third interest,and Harriett Ellis,John T.Smith, <br />Benjamin H.Smith,and Martha Moore,each take an undivided two- fifteenths interest,and Nannie M. <br />Norton,Mar y Stoner,Minnie Joyner,and Morris Emery Morris,each take an undivided one- thirtieth <br />interest in said lands. That no debts exist against said estate. That more than two years <br />have elapsed since the death of the said Joseph H.Smith,and no application has been made for <br />administration and no debts are now provable against his estate.That his estate is notliable <br />for inheritance taxes under the laws of the State of Nebraska.That there is no personal estate <br />in Nebraska,and no necessity exists for the appointment of an administrator. <br />It is therefore considered by the court that the said Joseph H.Smith died at the time and <br />place above found,a resident of Hancock County,in the State of Illinois. That he left an estate <br />i <br />�n Nebraska as above found. That he left a last will and testament which has been full admitted <br />to probate in the Countjc Court of Hancock County,Illinois,an authenticated copy in due form of <br />law being filed in this court,and that the same is hereby admitted to probate and allowed as the <br />last will and testament of the deceased in this state.That said estate is not liable for inher- <br />itance taxes. That all claims against his estate are forever barred. That the estate of the de- <br />ceased in Nebraska,pass to the devises and heirs at law as above named in the shares above set <br />forth, the same being in accordance to the terms of the will of the deceased.That further admin. <br />istration be dispeheed with. <br />(SEAL) <br />J.
