<br />WILL AND CERTIFICATE AND FINAL DECREE
<br />I,Joseph H. Smith of Augusta,in the County of Hancock and State of Illinois,being of sound
<br />mind and memory do hereby make,declare and publish this as my last will and testament:
<br />First: It is my will that all my just debts and funeral expenses be fully paid.
<br />Second: I hereby give to my beloved wif e,Frances Smith,my residence property in Aulgusta,
<br />Illinois,described as Lot Five (5) in Block Four (4) in the Original Plat of the Town,now
<br />Village of Augusta,in the County of Hancock and State of Illinois to have and to hold for and
<br />during her natural life,and at her death I hereby give said residence property to my brothers
<br />and sisters,share and share alike,the children of any deceased brother or sister thkl g`'the part
<br />of the deceased parent.
<br />Third: I hereby direct that my farm in Jackson Township,Hall County,Nebraska described as the
<br />Northeast quarter of Section Eight (8) in Township Ten (10) North,Range Twelve (12) West in
<br />the County of Hall and State of Nebraska be sold by my executors hereinafter named and the pro-
<br />seeds arising therefrom be divided in manner following: one - third thereof to bepaid to my said
<br />wife,Frances Smith,as her sole and absolute property forever,and the remaining two - thirds to
<br />be divided equally among my brothers and sisters,the children of any deceased brother or sister
<br />taking in equil parts the share its parent would have received if living at the time of my
<br />death.
<br />It is my will and I hereby direct that my said wife Frances Smith shall have the income from
<br />said farm until the same is sold by my said executors hereinafter named.
<br />I give myrexecutors full power and authority to sell my said farm in Hall County,Nebraska,
<br />either at public or private sale,as they may deem best,and for the purpose of passing title
<br />to said.praperty when sold by them,I authorize such executors to execute such writings,deeds
<br />and other instruments as maybe necessary and proper to pass title to the purchaser thereof.
<br />Fourth: I hereby give all the rest,residue and remainder of my property,of every kind and
<br />character,to my said wife,Frances Smith,as her sole and absolute property forever.
<br />Fifth: In the event that residence property in August,Illinois,is destroyed by fire it is
<br />my will that my said wife shall hame such part of the insurance money received as she may desire
<br />with which to rebuild a dwelling on said lot.
<br />Sixth: I believe my brother Simeon Smith to be deceased,but should he be living I direct
<br />that he shall receive no part of my estate.
<br />Seventh: I hereby appoint and nominate my said wife Frances Smith and my friend R. R. Foster
<br />of Augusta,Illinois,Executors of this my last will and Testament without surety on their
<br />Executors' bond.
<br />In witness whereof I have hereunto set my hand and seal this 24th day of January A.D.1922.

<br />The above instrument was now here signed and sealed by Joseph H.Smith,the testator,in the
<br />presence of each of us;and was at the same time published and declared by him to be his last
<br />will and testament and we,at his request and in- hispresence and in the presence of each other,
<br />have seve,ually subscribed our names hereto as attesting witnesses.
