<br />and the Court finds that the personal property owned by said deceased at the time of his dea.th,'
<br />aside from the household furniture,was of the value of $5121.30,and the said Mianda McMaster is
<br />entitled toreceive therefrom the sum of $1707.10.
<br />The Court further finds that said executor has paid all debts against said esta.te,the funeral
<br />expenses of said deceased,the costs of this proaeeding,and theinheritanee tax due from said estate,
<br />and there remains in his hands of the personal estate of said deceased,after such payments,and
<br />the payment of the legacy of $1707.10 in favor of Mianda Mclliaster,and the $3000 legacy in favor
<br />of Mildred Ellis,the sum of $2066.08,and under the terms and provisions of the last will and testa-
<br />ment of the said Benjamin C.MeMaster,deceased,the same passes,by absolute title,to Benjamin C.
<br />McMaster,Jr.,and Brace M.Rumbarger,son and daughter,of said deceased,share and share alike.
<br />The Court further finds that the said :renjamin C. Mc''aaster,died seized by fee simple title of
<br />the following described real estate situated in the county of Hall and state of Nebraska,to -wit:
<br />The Nest half of the northwest quarter of Section Twenty -one (21),and the Northeast quarter
<br />of Section Twenty -nine (29) ,both in Township Eleven (11) ,North,Range Ten (10) ,"Vest; the south
<br />thirty acres of the southwest quarter of the northeast quarter of Section Five (5),the east
<br />half of the northeast quarter of Section Five (5),the north or_eafourth of the southwest quarter
<br />of the northeast quarter and that part of the northwest quarter of the northeast quarter and the
<br />northeast quarter of the northwest quarter of said Section 5 lying south of the right -of- way
<br />of the Union Pacific Railroad Company,in Township Ten (10) North,Range Ten (10) West.
<br />The Court further finds that under the terms and provisions of the last will and testament of
<br />the said Benjamin c. Pdc!Aaster, Mianda McMa.ster,his surviving widow,takes ; a life estate in the north-
<br />east quarter of Section 29,in Township 11 North,Range 10 'Nest ire Hall County,Nebraska,and upon
<br />the death of the said Mianda McMaster,Benjamin C. McMaster,Jr. ,takes a�ife estate in the west
<br />half of the northeast quarter of said Section 29.,without power in the said Benjamin C. McMaster,Jr. ,
<br />to sell,alienate,assign,or incumber the same,and no debts or obligations contracted by hirn shall
<br />create a lien thereon,and upon the death of the said Benjamin C. McMa.ster,Jr. ,the title to said
<br />west half of the northeast quarter of said Section 29 passes by absolute title as provided
<br />by the terms of the last will and testament of the said Benjamin C.McMaster,deceased,and under
<br />the provisions of the last will and testament of the said Benjamin C.McMaster,deceased,upon the
<br />death of said Mianda McIaster,Grace M.Ruipbarger,daughter of said deceased,takes a�ife estate
<br />in the east half of the northeast quarter of said Section 29,without power in the said Grace
<br />M.Rumbarger to sell,alienate,assign,or incurnber the same,and no debts or obligations con tracted
<br />by her shall create a lien thereon,and upon the death of the said Grace M.RurAbarger the title
<br />to said east half of the northeast quarter of said Section 29 passes by absolute title as pro-
<br />vided by the terms of the last will and testament of the said Benjamin C.McMaster,deceased.
<br />The Court further finds that under tlye terms and provisions of the last will and testament
<br />of the said Benjamin C.McMaster,deceased,Benjamin C.Mc!4a.ster,Junior,takes a�ife estate in the
<br />southwest quarter of the northwest quarter of section 21,in Township 11 North,Range 10 West,in'
<br />Hall County, Nebraska, without power in the said Benjamin C. McMast er , Jr. , to s ell., ali enat e, or in-
<br />cumber the same,and no debts or obligations contracted by him shall create a lien thereon,aud:-
<br />upon the death of the said Benjamin C.McMa.ster,Jr.,the title to the southwest quarter of the
<br />northwest quarter of said Section 21 passes by absolute title as provided by the terms and
<br />provisions of the last will and testament of said deceased,Benjamin C.McMa.ster,and Grace M.Rum-
<br />barger,a daughter of said deceased,takes #ife estate in the northwest quarter of the northwest
<br />quarter of said Section 21,in Township 11,North,Range 10 ffest,in Hall County,Nebraska,without
<br />power in the said Grace M.Rumbarger to sell, alienate, assign, or incumber the same,and no debts
<br />or obligations contracted by her shall create a lien thereon,and upon the death of the said
<br />Grace M.Rumbarger the same passes by absolute title as provided by the terms and provisions
