<br />and all the property, real, personal, or mixed,including any and all insurance had,owned or poss-
<br />essed by me,on my life,now or hereafter acquired,of which I shall die seized and possessed,or
<br />to which I shall be entitled at the time of my decease,or subsequent thereto,I devise,bequeath
<br />and dispose thereof in the manner following,towit:
<br />First: My will is,that all my just debts and fungal expenses including the erection of a Mon -
<br />umant at my grave,and the costs of administering my estate, shall by my executor hereinafter named,
<br />be paid out of my personal property. If that be insufficient,I authorize my executor,hereafter
<br />named,as hereinafter provided,to sell so much of my real estate,as may be necessary for that
<br />purpose.
<br />Second. I herehy give the custody of my infant son,Fred C.Maurer,now eighteen years of age,during
<br />his minority,and while he remains unmarried,to my beloved son,Floyd E.Maurer,he the said guardian
<br />to have full and complete care,custody,education and control of the said minor,together with the
<br />property hereinafter bequeathed to him,the said minor,until he attains his majority.
<br />Third.I give and bequeath all the residue of my estate,real,personal and mixed,whether now
<br />owned by me,or hereafter acquired,and wherever situate,including all life insurance held,owned or
<br />possessed by me on my life,of every kind and nature,whether herein specifically described or not',
<br />try my beloved children Floyd E. Maurer,Hazel M. Marks,Ruth E. Borders and Fred C. Maurer, share and
<br />share alike,as tenants in common,to be held and to be paid them and each thereof,by my executor
<br />hereinadter named,as hereinafter directed.
<br />In case an)E one of my children shall die in my life time,leaving issue or descendants,I direct
<br />that his or her share shall not lapse,but shall be paid to such descendants in equal proportions.
<br />Fourth.I appoint my said son Floyd 1:Maurer,executor of this my last will and testament.If he
<br />should die,or refuse to serve as such,then and that case,I hereby appoint my friend Willard L.
<br />Keller,executor of this my last will and testament,in his place and stead,and with all the author-
<br />ities,and powers,rights and duties imposed on my said beloved son,Floyd E.Maurer,if he had accepted
<br />the trust,gaveVbond,qualified and entered upon his duties as such executor,under this my last
<br />will and testament,and further it is my wish that my executor,either my said son or said Keller
<br />be not required to give bond.
<br />Fifth.It is my wish.thd I hereby direct,that immediately upon my death,my said executor,
<br />Floyd E.Maurer,shall have and become possessed and have control of all my property, real, personal
<br />and mixed. That my house hold goods of every kind and nature be not sold,but they be divided
<br />among my aforesaid children,as may suit the will and wish of my said children,share and share
<br />alike,or as nearly so as possible,hereby trusting that each will exercise toward the other,that
<br />brotherly and sisterly spirit that becometh them,However I direct that the piano go to Ruth
<br />Borders in said diviaion.That all.of the other prop erty, real, personal or mixed,including the
<br />insurance hereinbefore referred to,be,by my said executor sold and reduced to cash,without pro-
<br />ceeding or proceedings in Court,hereby giving and granting unto my said executor,Floyd E.Maurer,':
<br />and to his successor under this will,if such is appointed,full power,and authority generally,to'
<br />do and perform all and every act and thing whatsoever requisite or proper to effectuate the said
<br />sale or sales of the said respective properties,and all thereof,and to collect all debts owing
<br />me or my estate,and insurance,with the same powers,and to all intents and purposes,with the,
<br />same validity as I,if personally present,cQ$ld,and that he execute,sign,acknowledge,and deliver
<br />any and all deeds,contracts and other instruments necessary to convey a good and perfect title
<br />in and to all of the aforesaid property,as such executor.
<br />Sixth.That out of the proceeds received by my said executor from the sale of the aforesaid pro -
<br />perty,and the collection of the aforesaid debts,and insurance,I direct that he first pay the
<br />charges covered by the first paragraph of this will.
<br />Second,that he deduct from the residue thereof,and pay to himself, individually, one fourth thereof,
<br />and to Hazel M.Marks,one fourth thereof,to Ruth E.Borders one fourth thereof,and that he retain
