<br />testate at his home in Hall County,Nebraska,on or about the 15th day of April,1891,that more
<br />than two years have elapsed between his death and the filing of the petition herein;that no
<br />application or petition has ever been fil ed for the administration of the estate of the said
<br />Sylvester McKee,deceased,in the state of Nebraska,nor has his estate ever been administered
<br />upon in the state of Nebraska;that said Sylvester McKee died seized as the owner in fee simple
<br />title of an undivided one -fifth of the South half of the Southwest quarter of Section Seven
<br />(7) in Township Nine ( 9 ) North, Range Twelve (12 ) West of the 6th P. M. , in Hall County,Nebraska;
<br />that said Sylvester McKee left surviving him,as his heirs at law and his only heirs at law,and
<br />next of kin,Mary McKee,his surviving mother,Caroline McKee,afterwards inter - married with one
<br />John A.Gee,a sister,Stephen McKee,David McKee,and James McKee,brothers,and that upon the death
<br />of the said Sylvester McKee,the real estate hereinbefore described passed and descended,under
<br />the intestate laws of the state of Nebraska then in force,in equal shares to the said Mary McKee]
<br />Caroline McKee,Stephen McKee,David McKee,and James McKee,mother,sister,and brothers,of laid
<br />deceased,whose degree of kinship to said deceased was that of mother,sister,and brothers;that
<br />the petitioner,Dora Hillis the present owner of the real estate hereinbefore described and a
<br />competent and proper person to prosecute this proceeding for the purpose of determining the time
<br />and place of the death of the said Sylvester McKee,that he died intestate,determining who were
<br />his heirs at law,their degree of kinship to him and the right of descent of the real estate
<br />owned by said deceased at his death.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all debts of the said Sylvester
<br />McKee,deceased,if any such exist,are forever barred and precluded;that.further administration
<br />of the estate of the said Sylvester McKee,deceased,is hereby dispensed with and his estate is
<br />hereby forever settled and closed.
<br />The Court further finds that Stephen McKee,a son of Stephen J. McKee,deceased,departed this
<br />life,intestate,at his home in Hall County,Nebraska,on or about the 10th day of March,196 6,aged
<br />twenty -two years,never having been married,and leaving no issue him surviving,and that he left
<br />surviving him,as his heirs at law and next of kin,and his only heirs at law and next of kin,Mary
<br />McKee,his surviving mother,Caroline McKee,a sister,David McKee,and James McKee,bsotihers,whose
<br />degree of kinship to said Stephen McKee,deceased,was that of mother,sister,and brothers,and
<br />that at the time of his death the said Stephen McKee was the owner of an undivided six-twenty-
<br />fifths of the south half of the southwest quarter of Section 7,in Township 9 North,Range 12
<br />Westin Hall County,Nebraska,and that upon his death the same passed and descended,under the
<br />intestate laws of the state of Nebraska then in force,in equal shares to said Mary McKee,his
<br />mother,Caroline McKee,his sister,and David McKee and James McKee,his brothers;that more than
<br />two years have elapsed since the death of the said Stephen McKee and no application or petition
<br />has ever been filed in the state of Nebraska for the appointment of an administrator of his !
