<br />"dindolph,under and by virtue of the provisions of the last will and testament to John H. Windolph
<br />in trust for Chester Charles '"indolph,Lucas A.'"indolph and 'Marie Magdplena lfindolph,gra.nd- child-
<br />ren of the testa.tor,to be held,contxolled and managed by said trustee for the benefit of said
<br />grand- child.ren,until the First day of January,1935 at which time he is required by the terms
<br />of the will to settle his account with said grand- children and to convey said lot to them
<br />or to their heirs.

<br />Now,on this 27th day of September,1924,this cause came for hear-
<br />ing upon the petition of Dora Hill,present owner,by fee simple title,of the south half of the
<br />southwest quarter of Section 7,in Township 9 North,Ra.nge 12 West of the 6th P.M.,in Hall County,
<br />Nebraska,heretofore filed herein,praying for a settlement of the estates of Sylvester McKee,
<br />deceased,and Stephen McKee,deceased,and for a finding that they died intestate,the time and
<br />place of their respective death,for a determination of their respective heirs at law,and the
<br />degree of kinship to said deceaseds,respectively,and the right of descent of the real estate
<br />owned by said deceaseds,respectively,at the time of their death,said petitioner being represent-
<br />ed by Horth,Cleary & Suhr,her attorneys,and the Court having examined the records and files and
<br />being fully advised in the premises,finds that due and legal notice has been given to all per-
<br />sons of the time and place fixed for hearing ;rpon said petition by publication for three succ-
<br />essive weeks in the "Grand Island In dependent ",a legal newspaper published in Hall County,Neb-
<br />raska,as heretofore ordered by the Court,and the Court having listened to the testimony in support
<br />of said petition and being fully advised in the premises,finds that the allegations of said
<br />petition are true,and that the petitioner is the present owner of the premises hereinbefore des-
<br />cribed and is a proper person to institute and prosecute these proceedings;that said S '*lvester
<br />McKee,a son of Stephen J.McKee,deceased,departed this life,intestate,at his home in Hall County,
<br />Nebraska,on or about the 15th day of Apri1,1881,at the age of twelve years,never having been
<br />married,and that he left surviving him,as his heirs at law and his only heirs at law,Mary McKee',
