<br />THE COURT FINDS that under and by virtue of the provisions of the said last Will and Testament
<br />Lot Number Two in Block Number 79 in the Original Town,now City of Grand Island, Nebraska, did
<br />pass and descend,at the death of the said John L.Windolph,to Frank J.Windolph,his son,in absolute
<br />title.
<br />THE COURT FINDS that under and by virtue of the provisions of the last Will and Testament of
<br />said John L.TMrindolph,deceased,all of the Real Estate owned by the testator at the time of his
<br />death and situate in Section 21,in Township ll,of Range 9 'Nest of the 6th P.M.in Hall County,
<br />Nebra.ska,did pass and descend at his death to John H.77indolph,his son,in absolute title.
<br />THE COURT FINDS that under the provisions of said last "'dill and Testa:ient,the small piece
<br />of ground containing from 1 to 1 & acres in the South -west corner of Section 15 in Township
<br />11 North of Range 9 'Nest in Hall County,Nebraska,known as Lot No.15 of the County Sub - division
<br />of the "'hest -half of the South -west Quarter of said Section 15 did pass and descend at the death
<br />of the testator in the manner following:
<br />An undivided 31 interest therein to Anna. E. "Pindolph an undivided I interest thereon to John H.
<br />'Nindolph,and an undivided 3 interest thereinto Frank 1.WindOlph.
<br />THE COURT FINDS that under and bu virtue of the provisions of said last 17ill and Testament
<br />Lot No.S in Block No.79 of the Original Town,now City of Grand Island,Nebraska,did pass and
<br />descend at the death of the testator to John H.'Vindolph,in trust,however,for Chester Charles
<br />Xindolph, Lucas A. Windolph,and 12arie Madgalena , indolph,grand= children of the said John L. Mind-
<br />olph,the said trustee,to hold, manage, rent and control said property in trust for said grand
<br />children until the 1st day of January,1935,at which time said trustee shall settle his account
<br />with said grandchildren and shall convey said premises to them or to their heirs.
<br />IT IS THER7FORE CONSIDER,D BY THE COURT that Lot 2 in Block 79 of the Original Town,now City
<br />of Grand sland,in Hall County,Nebraska,did pass and descend at the death of John L.7lindolph
<br />by virtue of the provisions of his last will and testament,to Frank J.Windolph,his son;that all
<br />of the Real Estate owned by the said John L. Y7indolph in Section 21,tovnship 11,Range 9,77est
<br />of the 6th P.M.,in Hall County,Nebra.ska,did pass and descend,at his death,under the provisions
<br />of dais last will and testament to John H. Windolph,his son; that the small piece of ground contairt-
<br />ing from one to one and one half acres in the South -west corner of Section 15 Township 11 Range
<br />9 in Hall County,Nebra.ska,known as Lot NO-15 of the County Sub- division of the ':Test of the i
<br />South -west of said Section 15 did pass and. descend at the death of the testator of Frank J.
<br />7indolph2John H.Nindolph,and Anne E.7Tindolph in equal ahares,each of them taking an undivided
<br />one -third part thereof.
