<br />in this office;that there remains no money or other personal property in the possession of said

<br />TIE, COURT FINDS that notice was given to all creditors of said deceased,by publication for
<br />4 successive weeks as required by la.w,of the time allowed and place a.p-oointed for filing claims
<br />against the estate of said deceased and that the ti- -aie so allowed for filing claims has fully
<br />expired;that all claims outstanding against said deceased and not filed within the time limited
<br />for filing claims are therefore forever warred and excluded;that all claims filed and. allowed
<br />against said estate have been paid and satisfied.
<br />THE COURT FINDS that said Mary F.Fezell departed this life on the 5th day of March,1922,that
<br />she was at the time her
<br />of death a resident and inhabitant of Hall County,Nebraska,a.nd that she
<br />died intestate,leaving surviving her as her heirs at la.,i and her sole and only heirs at law,
<br />John C.Fezell,her husband,a.nd Mary. Fezell,her daughter.
<br />THE COURT FURTHER FINDS that the said Mary F.Fezell died seized in fee ofthe following des -
<br />cribed real estate situate in the county of Hall and State of Nebraska,to -wit: Lots One (1)
<br />in Block Fifteen (15),in Russell Wheeler's Addition to the City of Grand Island;that title to
<br />this property was taken and now stands in the name of Mary Frances Fezell.
<br />.THE COURT FINDS that under the law of descent of the State of Nebra.ska,the above mentioned
<br />and described real estate did pass and descend at the death of the said Mary F.Fezell,intesta.te,
<br />in the manner following:
<br />To John Fezell,her husband an undivided one half thereof;
<br />To Mary Fezell,her d.aughter,an undivided one -half thereof,subject to the homestead right of the
<br />said John C.Fezell,in and to said property.
<br />IT IS THEREFORE CONSIDERTD,ADJUDGED,AND DECREED that all of the right,title and interest of
<br />Mary F.Fezell in and to Lot One (1) in Block Fifteen (15),in Russell Wheeler's Addition to the
<br />City of Grand Island In Hall County,Nebraska, did pass and descend at her death to John C. Fezell,
<br />her husband and Mary Fezell,her da.ughter,in equal shares,the latter taking subject to the home -
<br />stead right of the said John C.Fezell in and to said real estate,and the Court awards it to them.
<br />IT IS FURTHER 0011VSILER7D BY TIE COURT that all persons are forever barred from filing or sett-
<br />ing up any claims or demands against the estate of Mary F. Fez ell, deceased.
<br />IT IS FURTHER CONSIDERED BY THE COURT that the report of the GRAND ISLAND LOAM & TRUST COMPANY;,
<br />administrator,be and the same hereby is approved and allowed as and for its final account and it
<br />is discharged of its trust.
