4 (e a <br />County,Nebraska and <br />The following described real estate situated in Hall County,Nebraska to -wit: Beginning at the <br />intersection of the North line of the right -of -way of the Hastings and Northwestern Railroad, <br />with the West Line of Section Thirty- one;thence North along said West Line to the channel of the <br />Platte River;thence along said river to a point 935.4 feet East of said West Line;thence South <br />parallel with said West Line 1240.9 feet;thence East at right angles 426.6 feet;thence South <br />parallel with said West Line to thelaid out Island Road;thence Southwesterly along said road <br />to the right of way of the Hastings and Northwestern Railroad,thence along said right -of -way <br />to the point of beginning, containing 100.2 acres,according to the survey -M;"de by E.H. Morey, <br />Engineer.All in Section 31,Twp.9 North of Range 12,West of the 6th P.M. <br />The Court further finds that subsequent to the death of John R.Hilsabeck Martha J.Hilbabeck <br />the Petitioner became the owner of said real estate by purchase and conveyance thereof to her <br />as follows: That on or about the 5th day of May,1923,the said children of the deceased by deed <br />in due form duly executed and delivered,conveyed all their right,title and interest in and to <br />the premises hereinbefore described;to petitioner,and she is now the absolute owner in possession <br />of said premises. <br />The Court further finds that more than two years have elapsed since the death of John R. <br />Hilsabeck and that no application has been made in the State of Nebraska for the appointment of <br />an administrator,either by the heirs of said deceased,or by persons claiming to be creditors of <br />his,or otherwise. <br />The Court further finds that the heirs and next of kin of said John R.Hilsabeck at the time <br />of his death were as follows: <br />Martha J. Hilsabeck ,widow,Hastings,Nebraska; <br />Nora L.Proctor,daughter, " " ; <br />Bertrum J.Hilsabeck,son,Kenesaw, <br />Clement H.Hilsabeck,son Henry, <br />Ardella M.Alcorn,daughter Hastings, " ; and <br />L. Clyde Hilsabeck,gQ'1.0r.�' na, " <br />that all of said persons are of legal age;that the deceased left surviving him no other son or <br />daughter,nor the issue of any deceased child. <br />It is therefore Ordered, Adjudged, Decreed and Determined by the Court: <br />1 <br />1 <br />That John R.Hilsabeck died intestate. <br />That the Petitioner,Martha J.Hilsabeck became the owner in fee of the above described premises <br />by purchase and conveyance to Pfi as described in paragraph four herein. <br />That there are no creditors of said estate. <br />That more than two years have elapsed since the death of said John R.Hilsabeck <br />That the sole heirs at law and next of kin of said John R.Hilsabeck at the time of his <br />death were as follows: Martha J.Hilsabeek,widow;Nora L.Proctor,daughter ;Bertram J.Hilsabeek,son; <br />Clement H. Hilsabeck, son; Ardella M. Alcorn,daughter,and L.
