<br />H. D. Aikins, DECEASED.
<br />Now on this 5th,day of April,A.D.,1024,this cause came on for hear -
<br />ing on the petition of E. G. Kroger for the probate of the will of H. D. Aikins, deceased,and the
<br />said E.G.Kroger appearing in person, and no creditors or heirs having appeared,and it. appearing
<br />i
<br />to the Court from the proof on file that notice of the pendency of this petition has been given
<br />.to all parties interested in said estate as by the order of said Court heretofore made and enter-:
<br />ed;whereupon the said E.G-Kroger vas sworn and his testimony taken,and a duly authenticated
<br />copy of the last will and testa °dent of H.D. Aikins ,ryas introduced in evidence with the certificate
<br />of probate thereof by the District Court of Madison County,Iowa; and it appearing to the Court
<br />from said authenticated copy of said .fill and t'--e probate thereof,duly authenticated by the
<br />Clerk of the District Court of Madison County,State of Iowa,that said will has been duly ad-
<br />mitted to probate in said District Coutt of Madison Courty,Iowa,and that the said H.D.Aikins
<br />I
<br />died seized of real estate in Hall County,Nebraska,and that said instrument ought to be allowed
<br />as the last grill and testament of the said H. D. Aikins.
<br />The Court further finds from the proof on file and the testimony taken,that more than two year's
<br />have elapsed since the death of the said H.t.Aikins and that no steps have been taken heretofore
<br />to have the said will admitted to probate in this State.
<br />IT I$,THEREFORE,CONSIDERED BY THE COURT that said authenticated copy of said will of the said
<br />H.D.Aikins be allowed and admitted to probate within this Court and given the same force and effect
<br />as if originally probated in the County Court of Hall Colanty,Nebraska.
<br />IT IS FURTHER ORDERED that the regular administration of the estate of the deceased be dis-
<br />pensed with;that all claims against said Estate,if any there be,be and the same are hereby for-
<br />. ;
<br />ever barred and precluded; that the real estate belonging. to the deceased situate in Hall County,
<br />to -wit:- Lots Five (5),Seven (7),Nine (9),Eleven (11),Thirteen (13),and Fifteen (15) in Block
<br />Twenty -three (23),of College Addition to Nest Lawn,an Addition in the City of Grand Island,Hall
<br />County,Nebraska,passed and descended according to the terms of said will to Anne Eliza Aikins in
<br />fee simple and the same is hereby awarded to her,free from all debts against the decedent,and the;
<br />estate is closed.
