�1 <br />No. 3, HALL COUNTY <br />2572 —Elopp Printing Co., Omaha <br />excluded from setting up or asserting any such claims against said estate. <br />The Court further finds that the estate of the said John Rushen, deceased, was not subject <br />to an inheritance tax wider the laws of the state of Nebraska,that said executrix has paid <br />the funeral expenses of said deceased,the debts against said estate,and the costs of this pro- <br />±ceeding,and that there remains in the possession of said executrix,for distribution under the <br />terms of the will of said deceased,the sun of $597.84 in cash,three promissory notes of J.E. <br />Cox,one for $500,and two for $100 each,a half interest in an -$800 note of Henry Stoeger,a half <br />interest in a promissory note for $1500 of H.H.Shouse,and half interest in a promissory note of <br />Elmer H. Vanhoosen for $4000,and star Savings Certificates of the par value of $200,and that <br />s <br />said executrix has duly delivered said cash and other personal property to Emma Rushen,surviving <br />widow of said deceased.,to whom the same was bequeathed for her lifetime under the provisions <br />of the will of said deceased,with the privilege to sell therefrom so much as shall be necessary <br />of either the personal property or real estate of said deceased to provide the said Emma Rushen <br />,ith a comfortable home and maintenance during the whole of her natural life. <br />The Court further finds that the said John Rushen died seized as the owner by fee simple title^ <br />of the following described real estate situated in the county of Hall and state of Nebraska, <br />to -wit: Lots Five (5) and Six (6),in Block Three (3),in the original Town of Cairo,Nebraska,the <br />same being the home and homestead of said deceased and the said Emma Rushen,his wife,at the time <br />of the death of the said John Rushen,also an undivided one -half of Lot Five (5),in Block Eleven <br />,(11),of the Original Town of Cairo,Nebraska. <br />The Court further finds that under the terms and :provisions of the last will and testament of <br />the said John Rushen,deceased,the said Emma Rushen,his surviving widow, takes a life estate in all <br />of the real estate herein described,zrith the privilege of selling said real estate if necessary <br />to provide the said Emma Rushen with a comfortable home and maintenance during the period of <br />her natural life. <br />The Court further finds that anything that remains of the estate of the said John Rushen,de- g <br />ceased,either real or personal,at the time of the death of the said Emma Rushen,sha.11 be disposed <br />of as provided by the terms of the last will and testament of said deceased. <br />IT IS ,THEREFORE,ORDERED,ADJUDGED,AND DECREED BY THE COURT that the final report of the said <br />i <br />Emma Rushen,as executrix of the last will and testament of the said John Rushen,,b and the same <br />hereby is,a.11owed and approved as and for her final report,said estate is settled and closed <br />and said executrix discharged. <br />IT IS F UF?THF1Z ORDERED, ADJUDGED, AND DECREED BY TIFZ COURT that all persons having claims again$t <br />the estate of the said John Rushen,deceased,if any such there be,are forever barred and excluded <br />from setting up or asserting any such claims against saic estate. <br />IT IS FURTHER ORDERED ,ADJUDGED ,AND DECREED that under the terms and provisions of the last <br />will and testament of the said John Rushen,deceased,Emma Rushen,surviving widow of said deceased, <br />i <br />takes a life estate in all of the property,both real and personal,belonging to said deceased, <br />with the right ,privilege,and authority to sell the same, or any part thereof , in the event it is <br />necessary so to do to provide the said Emma Rushen with a comfortable home and maintenance during' <br />her natural life and if anythin g remains od the estate of the said John Rushen upon the death <br />of the said Emma Rushen,tie same shall be distributed as provided by t3e, terms of the said last <br />will and testament of the said John Rushen,decea.sed. <br />J.
