r <br />rgii � <br />he is required to account.That the Administrator has paid out certain moneys on account of fun- <br />eral expenses and costs of administering said estate and that all of said bills for funeral <br />expenses and costs of administering said estate have been paid in full.That said Administrator <br />makes no claim for the amount that he has paid out in excess of his receipts. <br />The Court finds that said estate is not subject to an Inheritance Tax under the Laws of the <br />State of Nebraska. <br />The Court further finds that the said Martin Burke,Deceased,departed this life on the 211 day <br />of July,1923,at his home in Hall County,Nebraska,and that he died intestate. <br />That the said Martin Burke,deceased,left surviving as his sole and only heirsa.tlaw the follow- <br />ing named persons: <br />Minnie E. Burke of Portland,Oregon. <br />Emmet Burke of Hall County,Nebraska. <br />The Court further finds that the said Martin Burke died,seized as the owner in fee simple of <br />the following described real estate situated in Hall County, Nebraska, to -wit: <br />The East Half of the South -east Quarter and Lots One (1) and Two (2) on the Mainland in <br />Section Five ( 5) , Township Nine ( 9) North Range Ten (10) nest of the 6 P. M. ,in Hall County,Nebraska. <br />That under the law of descent in the State of Nebraska the said above described real estate <br />did pass and descend at the death of the said Martin Burke in the manner following: <br />To Minnie E.Burke and Emmet Burke,each an undivided one -half interest therein,absolutely,as <br />tenants in common. <br />It is,therefore,considered and adjudged by the Court that: <br />The East Half of the South -east Quarter and Lots One (1) and Two (2) on the Mainland in <br />Section Five (5) ,Township Nine (9) North Range Ten (10) , Pest of the 6 P. M. , in Hall County,Nebraska., <br />did pass and descend on the death of the said Martin Burke,deceased,to Minnie E.Burke and Emmet. <br />Burke,share and share alike,each taking an undivided one -half interest therein in fee simple and <br />as tenants in common. <br />J.
