<br />Now,on this 21st day of November,A.D.,1923,this cause came on for hearing upon the final re-
<br />port of Edward J.Tannehill,Executor of the last will and testament of Margaret Tannehill,deceased,
<br />and upon his petition for the settlement of said estate and his discharge herein,and the Court
<br />having examined the records and files and being fully advised in the premises,finds that due and
<br />legal notice has been given to all persons of the time and place fixed for hearing upon said re-
<br />port and petition,as heretofore ordered by the Court.
<br />And the Court,having examined said report,together with the vouchers on file,finds that said
<br />report is true and correct in all things and that the same ought to be approved and allowed as
<br />and for the final report of the said Edward J. Tannehill as executor of the last will and testament
<br />of the said Margaret Tannehill,deceased.
<br />The Court further finds that due and legal notice has been given to all persons of the time
<br />and place fixed for filing claims against said estate,and that the time so fixed has fully
<br />expired,and no claims -.have been filed against said estate,and that all persons having claims
<br />against said estate,if any such there be,are forever barred and excluded from setting up or
<br />asserting any such claims against said estate.
<br />The Court further finds that the said Margaret Tannehill departed this life,testate,at her
<br />home in Hall County,Nebraska,on the 4th day of April,1923,and at the time of her death the
<br />said Margaret Tannehill was a resident and inhhbitant of Hall Count y,Nebraska;that on the 5th day
<br />of May,1923,the last will and testament of the said Margaret Tannehill was duly proven,allowed,and
<br />admitted to probate in this Court and letters testamentary issued thereon to the said Edward J.
<br />Tannehill as provided by the terms of said will.
<br />The Court further finds that the said Edward J.Tannehill,as such executor,has paid the funeral
<br />expenses of said deceased,all debts against said estate,and the costs of this proceeding,and that
<br />there remains in his hands for distribution to the legatees under the will of said deceased the
<br />sum of $1269.24,which sum,under the terms and provisions of the last will and testament of said
<br />deceased,was bequeathed,in equal shares,to Edward J.Tannehill,Martin V.Tannehill,and lelma Richter,
<br />sons and daughter of said deceased,in equal shares,and said executor has duly distributed the same
<br />to said legatees,and nothing further remains in his possession belonging to said estate,that
<br />said estate ought to be settled and closed and said executor discharged.
<br />The Court further finds that the said Margaret Tannehill died seized as the owner,in fee simple,
<br />of the east half of the east thirty -six acres of the northwest quarter of the northeast quarter
<br />of Section Two (2),in Township Nine (9),North2Range Ten (10) West in Hall County,Nebraska,and
<br />upon the death of the said Margaret Tannehill the same passed,under t#e terms and provisions of
<br />the last will of said deceased,in equal shares and by absolute title to Edward J.Tannehill,Martih
<br />V.Tannehill,Margaret May Cotton,and Zelma Richter,share and share alike.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURTthat the final report of the said
<br />Edward J.Tannehill as executor of the last will and testament of the said Margaret Tannehill,
<br />deceased,be,and the same hereby is,approved,and allowed as and for the final report of said exe
<br />cutor,said estate is settled and closed and said executor is discharged..
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that the estate of the said Margaret
<br />Tannehill,deceased,was not of sufficient value to subject it to an inheritance tax under the laws
<br />of the state of Nebraska.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all persons having claims against
<br />the estate of said deceased,if any such there be,are forever barred,enjoined,and excluded from
<br />setting up or asserting any such claims against said estate.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that under the terms and provisions
<br />of the last will and testament of the said Margaret Tannehill,deceased,the real estate hereinbefore
<br />described passed,by absolute title,to Edward J.Tannehill,Martin V.Tannehill,Margaret May Cotton,;
<br />and Zelma Richter,sons and daughters of said deceased,share and share alike,and distribution thereof
