<br />Eight (9) in Block Five (5) in College Addition to West Lawn in Grand Island,Nebraska.
<br />THE COURT FINDS that the widow of said deceased,who was under the provisions of the Last
<br />Will and Testament given a life estate in the above described real estate,has filed in this
<br />court her refusal to take under the provisions of the Will and her election to take under the
<br />law of descent of the State of Nebraska.
<br />THE COURT THEREFORE FINDS that the above mentioned and described real estate did pass and
<br />descend at the death of the said Joseph F.A.McCurry,in the manner following to -wit:-
<br />To Mary Jane McCurry,his widow,an undivided one - fourth ( +) part thereof;and to Daniel F.McCurry$
<br />Minerva Sorge; and ",'Tilliam Herbert McCurry, each an undivided one - fourth (�) part thereof sub -
<br />ject to the homestead right of the said Mary Jane McCurry,widow therein.
<br />IT IS THEREFORE CONSIDERED,ADJUDGED AND DECREED that,all of the right,title and interest of
<br />Joseph F.A.McCurry in and to Lots 6 and 8 in Block 5,in College Addition to West Lawn in Grand
<br />Island,Hall County,Nebraska,did pass and descend at the death of Joseph F.A.McCurry under the
<br />provisions of his last will and testament as modififed by the widow's election,to Mary Jane
<br />McCurry,Daniel F. McCurry,Minerva Sorge and WilliamHerb.,rt McCurry',-each an undivided one - fourth
<br />interest therein,the said Daniel F.McCurry,Minerva Sorge and WilliamHerbert McCurry taking
<br />subject to the homestead right of the said Mary Jane McCurry,and the court awards it to them.
