<br />The Court finds that the said Carl Bach,deceased,took title to said hot 4 and 5 in said Bloct
<br />3 and that said title stands of record,in the name of "Carl Bach." That the said Carl Bach,dece-
<br />ased,took title to Lots 6 and 7 in said Block 3,above deseribed,in the name of and that said
<br />title stands of record in the name of "Carl G.Bach."
<br />That under the law of descent of the State of Nebraska the said real estate did pass and
<br />descend at the death of the said Carl Bach,deceased,in the manner following :;
<br />To Felix Bach and Mary Bach,father and mother of said deceased,and undivided one -half inter -
<br />est therein,as tenants in common,absolutely.
<br />It is therefore considered and adjudged by the Court that Lots 4,5,€,and 7 in Block 3 in
<br />Pleasant Hill Addition to the City of Grand Island,Nebra.ska,did pass and descend at the death
<br />of the said Carl Bach,deceased,in the manner following:
<br />To Felix Bach,father of said deceased,and to Mary Bach,mother of said deceased,each an un-
<br />divided one -half interest therein,absolutely,in fee simple as tenants in common.

<br />I,Charles A.Hofmann,of Grand Island,Nebraska,being of sound mind and disposing memory,do make
<br />and publish this;my last will and testament in the manner and form following,that is to say:
<br />FIRST.
<br />I direct that my just debts,if any,and the expenses attending my burial be first paid.
<br />SECOND.
<br />I give,devise and bequeath to my beloved wife,Minnie Hofman,in the event she surviv es me,all'.
<br />of my estate of whatsoever nature of which I shall die the owner,to have and to hold the same
<br />for her sole use and benefit during the period of her natural life. It is my purpose to protect
<br />my said wife to the fullest extent and I believe that this can best be done by giving her my
<br />entire estate for her lifetime,the income from which will be ample for her proper support and
<br />will reduce the chances of loss of the principal estate.I give and grant,unto my said wifd< .,full
<br />power and authority to use my personal estate,or any part thereof,for the purpose of making per-:
<br />manent improvements upon any real estate of which I shall the the owner.
<br />THIRD.
<br />I give,devise and bequeath all the rest,residue and remainder of my estate of whatsoever

<br />One fourth to my nephews,Christian Gohs,Carl Gohs and August Gohs,sons of my sister,Julian,
<br />Gohs,of Braubach- on- Rhine,Germany,and to the survivors of them;
<br />One fourth to my nieces and nephews,Christian Hofmann, CbLrl Hofmann :,Wilhelm "Hofmann,Elizabetha
<br />Hofmann,Maria Hofmann and Louisa Hofmann,children of my brother,Christian Hofmann,all formerly
<br />of0bernhof, near Nassau,Germany,and to the survivors of them,and One half to William Sievers
<br />and Otto Sievers,brothers of my wife,Minnie Hofmann,and to the survivor of them.

<br />FOURTH.
<br />I nominate and appoint my said wife,Minnie Hofmann,as executrix of this will,without bond.
