<br />IN THE COUNTY COURT,HALL COUNTY,NEBRASKA
<br />In the matter of the Estate
<br />of DECREE
<br />Anna M.Burger,Deceased
<br />Now on this 11" day of July,1923,this cause came on for hearing upon
<br />the petition of Zelma Willis,a daughter of said Anna M.Burger,deceased,and one of the heirs at law
<br />of the said Anna M.Burger,deceased,praying for settlement of the estate of said deceased,a .deter_
<br />urination of her heirs and the right of descent of her real property and the degree of kinship of
<br />said heirs at law and it appearing from the proof on file herein that due and legal notice by pub..
<br />lication for three successive weeks,as by law and the order of this court required,has been given,
<br />to all creditors,heirs at law and persons interested in said estate,of the filing of said petition
<br />and of the time and place for hearing dame,which time was more than thirty days and less than sixty
<br />days,after the filing of said petition,and there being no objections thereto,the cause was duly
<br />submitted to the court upon said petition,and the evidence and the court being duly advised in tie
<br />premises finds the allegations in the petition are t rue,that the said Anna M.Burger,died intestate
<br />on the 15th day of August,1916 in Grand Island,Hall County,Nebraska,that at the time of her death
<br />she was a resident of Hall County,Nebraska,and was the oiener of certain real property in said Hall
<br />County,Nebraska,that more than two years have elapsed since her death,that no application has been
<br />made in the State of Nebraska or any other state for the appointment of any administrator of her
<br />estate and nip administration has been had of said estate in the State of Nebraska.
<br />The court finds that the deceased left her surviving the following named heirs at:F.law:
<br />Albert H. Burger, surviving husband of Grand Island,Hall County, Nebraska.
<br />Zelma Willis,daughter,age 35 years,Grand Island,Nebr.
<br />Emma Tra.uner,daughter,age 37 years,Denver,Colorado.
<br />Meta Bisheld,daughter,age 28 years,Grand Island,Nebr.
<br />Hattie Von Rembow,daughter,age 41 years,Grand Islan d,Nebraska.
<br />Helen Black,daughter,age 23 years,Grand Island,Nebr.
<br />William Burger,son,age 33,Adams County,Nebraska.
<br />Hazel Burger,grand- daughter,age 17 years,Giltner,Nebr.
<br />That the said Hazel Burger is a grand - daughter of said Anna M.Burger,being the only child of
<br />Charles Burger,deceased,the said Charles Burger was a son of the said Anna M.Burger and that he
<br />died at St.Joseph,Missouri on the 14th day of August,1905.
<br />The Court further finds that the said Anna M.Burger,died seized in fee simple of the following
<br />described real estate:
<br />Lot One (1),Block Sixteen (16) in Wallich's Addition to the City Grand Islan d,Hali County,Nebraska.
<br />thich real estate did,upon the death of the said Anna M.Burger,pass and descend,by operation of law
<br />to the above named heirs at law as follows: Albert H.Burger,surviving husband of said deeeased,an
<br />undivided one -third of said real estate,and to the following:Zelma Willis,Emma Trauner,Meta Bisheld ,
<br />Hattie Von Rembow,Helen B1ack,William Burger,and Hazel Burger,as tenants in common,a 2/21 (two - twenty
<br />first) part to each.
<br />That said real estate consists of a vacant lot and was not the homestead of said Anna M.Burger,'
<br />deceased.
<br />The Court further finds that no petition for application has been filed in the State of Nebraska,
<br />or elsewhere,for the appointment of an administrator for the estate of said decegsed,and that i10
<br />administration has been had upon her estate in the State of Nebraska and that more than two years
<br />have elapsed since her death,and that she died intestate,and that her funeral expenses have been
<br />paid and that all the debts of said deceased for her estate have been paid or are forever barred and
<br />precluded and that the costs of these proceedings -have been paid.
<br />IT IS THEREFORE BY THE COURT ADJUDGED,CONSIDERED AND DECREED,that the said Anna M.Burger,died
<br />intestate more than two years prior to the filing of the petition in this cause,that no application
<br />for the appointment of an administrator of her estate has been made in the State of Nebraska,nor has
