11 e No. 39 HALL 2572 —Klopp Printing Co., Omaha _ DECREE F IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA. IN THE MATTER OF THE ESTATE OF DECREE LUCY W.CONANT,DECEASED. Now on this 31st day of July,1923,this cause came on for hearing upon the petition of Mary C.Seudder,heretofore filed herein,said petitioner being represented by Prince & Prince,her Attorneys,and,it appearing from the proof on file herein,that due and legal notice by publication in the "GRAND ISLAND INDEPENDENT" a legal newspaper in said county, for three successive weeks,as by law and the orders of this Court required,has been given to all, creditors,heirs at law and other persons interested in said estate,of the filing of said peti- tion and the time and place for hearing thereon,which time was more than thirty days and less than sixty days after the filing of said petition,and there being no objections thereto,said cause was submitted to the Court,upon the petition and the evidence of the petitioner in support thereof and the court being duly advised in the premises, finds:That the allegations of said pe- tition are true;that said Lucy W.Conant died intestate on the 21st day of September,1999 in Au- burn,Androscoggin County,Maine ;that she was at the time of her death,a resident of said Androsco ggin County,Maine and a non- resident of the State of Nebraska;that the said deceased left our- viving her as her heirs and only heirs at law,the following named persons,who bore the degree ofi. kinship to her as set forth after their names: Frank R.Conant,a son Albert H.Conant,a son Charles L.Conant,a son Carrie A.Conant,a daughter Lizzie C.Day a daughter Nathan C.Harris a grandson Lucy W. Harris a granddaughter; that the husband of the said Lucy W.Conant died prior to the death of the said Lucy W.Conant;tha� the said Lucy W.Conant dies seized of a fee simple title and an estate of inheritance in the f04- owing described real estate,situate in Hall County,Nebraska,to -wit: Lot rive (5),in Block Eleven> (11),Arnold & Abbott's Addition to the City of Grand 151and.Nebraskao, and:that upon her death,the said above described premises passed and descended,by operation of E law to the heirs at law of the said Lucy W.Conant in the following shares: Frank R.Conant one -sixth Albert H.Conant one -sixth Charles L.Conant one -sixth Carrie A.Conant one -sixth Nathan C.Harris one - twelfth Lucy W.Harris one - twelfth Lizzie C.Day one -sixth The Court further finds that more #ban two years have elapsed since the death of the said Lucy W.Conant;that no application has been made in the State of Nebraska forthe appointment i 3 of an administrator of her estate,nor has any petition been filed therefor,and no administration; has ever been had on his estate;that she died intestate;that the funeral expenses and other debts] and the costs of these proceedings have been fully paid,and that all other claims or debts of said estate or of said deceased,if any exist,are forever barred and precluded;that upon the deatY of the said Lucy W.Conant,the said above described real estate passed and descended to the heirs; at law of the said Lucy W.Conant,as herein above set forth;that said premises were sold at part -' ition sale in the District Court*of shill County„ Nebraska to Max J.Egge,who in turn sold premise to Mary C.Scudder,the petitioner,and that she is now the sole owner of said premises and holds the same by mesne conveyance farm the heirs of the said Lucy W.Conant,deceased,and is a proper person to bring this action.
