<br />The Court further finds that under and by virtue of the terms of the said Will *Mrs.Lucy Tupper.,,
<br />became the owner in fee simple of the South west Quarter (MY-) of Section Three (3) in Township,
<br />Eleven (11) Range Thirty five (35) Perkins County,Nebraska,containing 160 acres more or less
<br />according to government survey.

<br />The Court further finds that the said Hester Welpton, under and by virtue of the terms of the,
<br />Will,is the owner in fee simple of any other real estate,wherever, situated, owned by the said J.
<br />W.Welpton at the time of his decease,which may have been omitted from the probate proceedings by
<br />oversight.mist:,,ke or otherwise; such ownership in fee simple,bei r the same and to the same ex-
<br />tent us if such real estate was fully described and set out in this Decree.
<br />It is therefore considered and adjudged by the Court that each and all of the acts.done and
<br />performed by the said Hester Welpton,as said Executrix,be and the same is hereby allowed, approved
<br />and confirmed and that any and all other claims.which many arise.or Which have ari.sen,and which
<br />have not been filed,in this action,are hereby forever concluded and barred as a charge against
<br />said estate.
<br />Theref ore. whereas it appears from the records and proceedings of said Court,that the said
<br />Hester Welpton as said Executrix has in all things faithfully and justly performed and dischar8ed
<br />&11 and singular the duties and obligations which by law and the orderb of this Court were re-
<br />qui.red, of, and enjoined upon her as such executrix and that she has duly and fully accounted fo3r
<br />and administered all of said estate, whi ch has come into her possession in pursuance of law.
<br />Therefore,in consideration of the premises,she,the said Hester Welpton as such Executrix is
<br />hereby discharged, exonerated and acquitted from any and all liability and troubles concerning the

<br />administration of said estate and her doings and proceedings are forever quitted,in so far as all
<br />matters and things which have come before this Court are concerned and the Letters Testamentary "
<br />heretofore granted to her are hereby revoked and annulled, and the Bond heretofore given by her
<br />together with her bondsmen are hereby released and acquitted,iand any and 411 further liability
<br />of such bondsmen thereon is hereby cancelled and annulled.
