D. ,19 22, thi s cause came on for hearing upon the petition of Eva M.Wheeler.praying for the settlement of the estate of Fred Wheeler.deceased.for a determination of his heirship and the right of descent of his real estate and the degree of kinship of his heirs at law and a decree settling his estate.and ` it appearing to the court from the proofs on file herein that due and legal notice has been given by publication for three consecutive weeks,as by law and the order of this court provided, to all creditors,heirs at law,and other persons interested in said estate,of the filing of said petition and of the time and place fixed for the hearing of the saute whi ch^ was not less than thirty days and not more than sixty days after the filing of said petition and there being no objections made thereto,this cause was duly submitted to the court upon the petition and evidence in support thereof and the court being -fully advised in the premises finds that the allegatkons of said petition are true,and that said petitioner,Eva M- Wheeler,is one of the pre sent ownerd of the real estate hereinafter described and is a competent and proper person to prosecute this proceeding; that the said Fred Wheeler departed this life intestate at his home in Hall County,Nebraska, on the 27th day of January,A. D. 1917 and at the time of his death the said Fred Wheeler was a resident and inhabitant of Hall County,Nebraska,and died seized as the; owner in fee simple of Lots Nine (9) and Ten (10) in Block Ninety -one (91) of Wheeler & Bennettte Fourth Addition to the City of Grand Isla.nd,Nebraska,a,nd that more then two years have lapsed since his death and that no application has ever been made in the State. of Nebraska for the appointment of an Administrator of his estate and no petition filed for that purpose and no administration has ever been had upon the estate of the said Fred Wheeler,Deceased. The Court further finds that the said FVed Wheeler.left surviving hind as his heirs at law and his only heirs at law the following named persons: Eva M- Wheeler,petitioner herein,survivirig widow.Lloyd F- Wheeler,a son,age 22 years.Walter K- Wheeler,a son.age 19 years;Dwight A.Wheeler, a s on,15 y ears. Fern E- Wheel er, a. daughter, age 12 y ears, Garth H- Whe eler, a son age 10 vears; and Ruth L- Whe eler, a daughter, age 6 years.. i The Court further finds that under the Intestate Laws of the State of Nebraska in force at the time of the death of the said Fred Wheeler. the real estate hereinbefore described passed and descended by absolute title as follows:- To Eva M- Wheeler, surviving widow, one -third thereof To Lloyd F.
