D. ,19 22, thi s cause came on <br />for hearing upon the petition of Eva M.Wheeler.praying for the settlement of the estate of <br />Fred Wheeler.deceased.for a determination of his heirship and the right of descent of his <br />real estate and the degree of kinship of his heirs at law and a decree settling his estate.and ` <br />it appearing to the court from the proofs on file herein that due and legal notice has been <br />given by publication for three consecutive weeks,as by law and the order of this court provided, <br />to all creditors,heirs at law,and other persons interested in said estate,of the filing of said <br />petition and of the time and place fixed for the hearing of the saute whi ch^ was not less than <br />thirty days and not more than sixty days after the filing of said petition and there being no <br />objections made thereto,this cause was duly submitted to the court upon the petition and <br />evidence in support thereof and the court being -fully advised in the premises finds that the <br />allegatkons of said petition are true,and that said petitioner,Eva M- Wheeler,is one of the pre <br />sent ownerd of the real estate hereinafter described and is a competent and proper person to <br />prosecute this proceeding; that the said Fred Wheeler departed this life intestate at his home <br />in Hall County,Nebraska, on the 27th day of January,A. D. 1917 and at the time of his death the <br />said Fred Wheeler was a resident and inhabitant of Hall County,Nebraska,and died seized as the; <br />owner in fee simple of Lots Nine (9) and Ten (10) in Block Ninety -one (91) of Wheeler & Bennettte <br />Fourth Addition to the City of Grand Isla.nd,Nebraska,a,nd that more then two years have lapsed <br />since his death and that no application has ever been made in the State. of Nebraska for the <br />appointment of an Administrator of his estate and no petition filed for that purpose and no <br />administration has ever been had upon the estate of the said Fred Wheeler,Deceased. <br />The Court further finds that the said FVed Wheeler.left surviving hind as his heirs at law <br />and his only heirs at law the following named persons: Eva M- Wheeler,petitioner herein,survivirig <br />widow.Lloyd F- Wheeler,a son,age 22 years.Walter K- Wheeler,a son.age 19 years;Dwight A.Wheeler, <br />a s on,15 y ears. Fern E- Wheel er, a. daughter, age 12 y ears, Garth H- Whe eler, a son age 10 vears; and <br />Ruth L- Whe eler, a daughter, age 6 years.. <br />i <br />The Court further finds that under the Intestate Laws of the State of Nebraska in force at <br />the time of the death of the said Fred Wheeler. the real estate hereinbefore described passed <br />and descended by absolute title as follows:- <br />To Eva M- Wheeler, surviving widow, one -third thereof <br />To Lloyd F. Whe eler, a son, one -ninth thereof <br />To Walter K.Wheeler, " « « « <br />To Dwight A.Whee-ler, " <br />To Fern E- Wheeler.a daughter « " <br />To Garth H.Wheeler, a son <br />To Ruth L.
