<br />In the matter of the estate of
<br />Hannah Freitag, ) DECREE.
<br />Deceased.
<br />Now, on this 20th day of July,1921, this cause came on for
<br />hearing upon the petition of Robert Freitag,praying for a settlement of the estate of said
<br />deceased,for a detenninati.on of the heirship of said deceased,and the right of descent of the
<br />real estate left by said deceased,and the degree of kinship of said heirs at law.and a decree
<br />settling said estate,a.nd it appearing to the Court from the proof on file that due and legal
<br />notice has been given. by publication for three successive weeks, as by lave and the order of this
<br />Court provided, t o all creditors, hei rs at law, and other persons interested in said estate, of
<br />the filing; of said petition and of the time and place fixed for the hearing thereon,which time
<br />w-s not less than thirty days nor more than sixty days after the filing of said petition,and
<br />them being no objections thereto, this cause was duly submitted to the Court upon said:!petition
<br />and the evidence In support thereof,and the Court,being duly advised in the premises,finds that
<br />allegations of said petition are true,and that the said Robert Freitag,petitioner,is one of the
<br />heirs at law of the said Hannah Frei. tag, deceased, and is one of the present owners of the real
<br />estate hereinafter described,and isacompetent an #roper person to prosecute this proceeding; thal
<br />the said Hannah Freitag .departed this life, intestate, at her home in Hall County. Nebrasku-, on the
<br />the
<br />24th day of March,1918. and at the t me of her death the said Hannah Freitag was a resident and
<br />inhabitant of Hall County.Xebr"ska,and that she died seized as the owner in fee simple of Lot
<br />Five (5),in Block Five (5),in Dill & Huston's Addition to the City of Grand Isla.nd,in Hall
<br />County, Nebraska; that more than two years have elapsed since the death of the said Hannah Freitag,
<br />and that no .application has ever been made in the state of Nebraska for the appointment of an
<br />Administrator of her estate and no petition has ever been filed for that purpose ,and no admin-
<br />istration has ever been had upon the estate of said deceased.
<br />The Court further finds that said Hannah Freitag,deceased,left surviving her,a.s her heirs
<br />at law,and her only heirs at law,the following named persons;Robert Freitag,petitioner herein,
<br />surviving husband of said deceased; Frances Freitag,,,lbert Freitag,and Walter Freitag,a daughter
<br />and sons of said deceased,all of whom are of legal age;th"t upon the death of the said Hannah
<br />Freitag,the real estate hereinbefore described passed and descended,by absolute title,under the
<br />intestate laws of the state of Nebraska then in force,as follows: An undivided one -third to
<br />Robert Freitag,surviving husband of said deceaased,a.nd an undivided two- ninths each to the said
<br />Frances Freitug,Albert Freitag,and Walter Frei tag, daughter and sons of said deceased,and that
<br />said premises was not the home or homestead of said deceased at the time of her death.
<br />The Court further finds that the funeral expenses of said' deceased have been fully paid,and
<br />that all debts of said dec eased, and of her estate, if arV such existed, are forever barred and
<br />precluded and t.-"t t1w. costs of these proceedings have been fully paid.
<br />IT I8 THEMEFORF ORDER't',D, AD�TUDGFD,AN 0 DECREED BY T�ir COURT that the said Hannah Freitag died
<br />intestate in Hall County. Nebraska. on the 24th day of March,1918, and at the time of her death
<br />she was a resident and inhabitant of Hall County,Nebraska;that more than two years elapsed from
<br />the date of the death of said Hannah Freitug until the Riling of the petition in this cause;
<br />tn,.-t no ppplicatio /.of an administrator of her estate had ever been made,nor has th 'are ever been
<br />any administration upon the estate of said deceased; teat said deceased died seized as the owner
<br />in fee simple of the real estate hereinbefore described situated in Hull County.Nebra.ska;that
<br />the petitioner herein is a competent and qualified person to prosecute this proceeding;that sai
<br />deceased left surviving her,as her heirs at law,a.nd her only heirs at law,the said Robert Freit,
<br />surviving husband of said deceased,and Frances Freiteg,Albert Freitag,and Walter Freitag, daught *r
