<br />of Ella J. Peck,
<br />Deceased.. ) Now, on this 27th day of Tune,1921, this cause came on for hearin
<br />upon the petition of Benjamin F.Parks and Thomas Ellis, heretofore filed herein; praying for a
<br />settlementof the estate of Ella .T.Peck.(some time known as Eleanor J.Peck)deceased,that she
<br />dies intestatg,for a determination of her heirs at law.their degree of kinship to said deceased
<br />that the right of descent of the real estate owned by her.said petitioners being represented by
<br />Horth & Ryan,their attorneys,and the Court having heard the evidence in support thereof,and said
<br />cause being submitted to the Court and it being duly advised in the premises,finds that due and

<br />E legal notice by publication in the "Shelton Clipper ",a legal newspaper in said county.for three
<br />successive weeks prior to this hearing,had been duly given to all persons interested in said es-
<br />tote. including the heirs at law and creditors of said deceased, of the filing of said petition an
<br />the time and place for hearing thereon,which time was more than thirty days and not less than
<br />a sixty days after the filing of said petition,and no one appearing to object thereto,the said
<br />a cause was duly submitted to the Court upon said petition,proof of notice.and the evidence in
<br />support thereof,and the Court.being duly advised in the premises,finds that the allegations of the
<br />petition are true;that the said Ella J.peck died intestate at her home in Santa Barbara,Calif-
<br />i
<br />ornia, on September 4, 1912; that more than two years have elapsed since her death and no applica-
<br />tion or petition has been filed in the state of Nebraska for the appointment of any Administra-
<br />tor of her estate, "nd that no administration has been had of her estate therein.
<br />The Court further finds that said deceased left surviving her,as her only heirs at law and I
<br />next of kin.the following named persons: George K.Peck.her husband.and Edgar L.Peck,her son,and
<br />Blanche E- Coleman (formerly Peck),her daughter.all of whom were over twenty -one years of age at
<br />the time of her death. and that their 'A egree of kinship to her was that of surviving husband and
<br />children. That said deceased,as one of the heirs at law of Philip Smith,deceased.died seized of
<br />and the owner in fee of wn estate of inheritance of an undivided onethird interest in and to thel
<br />following described lands and premises: The Southeast quarter of Section 12.and the southeast
<br />quarter of Section 13,all in Township 9,Range 13 West.Buffalo County. Nebraska, and Lots 2,3,and 4I
<br />of Section 18,in Township 9.Range 12,in Hall County,Nebraska.which said real estate,and the in-
<br />terest of the deceased therein, did, upon her death.pass and descend,in absolute title under the
<br />laws of descent in the state of Nebraska then in force as to intestate decedents. to the said
<br />
