<br />above described blocks,dated February 5,1898,and recorded in Book 26 of Deeds at page 404 of tho

<br />Commencing at the southwest corner of the southeast quarter of the northwest quarter of said Se tion
<br />17,in Township 11, North,Range 9.running thence north along the west boundary line thereof,
<br />imately 962 feet,to the south line of Thomas Street,in said Westview;thence east along the sout .

<br />line of Thomas Street,approximately 911 feet,to the west line of Howard Street,in said Westview
<br />thence south along said '•west line of Howard Street.approxima.tely 966_feet,to the south boundary
<br />line.of the said southeast quarter of the northwest quarter of said Section 17;thence west alon
<br />said south boundary line.approximately 911 feet.to the place of 'beginning,and comprising 20
<br />acres.a little more or less.and thatby virtue of her said ownership of said real estate.this
<br />Court has 1urisdiction in this cause to Administer said estate which is situated in the state
<br />of Nebraska.
<br />The Court further finds from the proof on file herein that all special legacies under said
<br />will have been fully paid and satisfied under the administration of said estate in the state
<br />of New York,a.nd that said above described real estate situate in the state of Nebraska forms
<br />a. part of the residuary estate of said deceased and that under the terms of said last will and
<br />testament of said deceased said residuary estate was devised and bequeathed in'equal shares to
<br />Harry MoGrath.Anna Irene McGrath.and Edith Snyder Chaffee.named as residuary legatees and de-
<br />visees therein,in equal shares.
<br />The Court further finds from the proof on file herein and evidence submitted herein that s
<br />Anna Irene 'McGrath:died.intestate, unmarried.and without issue or descendante.prior to the deat
<br />of the said Sarah M,Peterson.and that said will made no provisions for the distribution of the
<br />share of said estate and property devised and bequeathed to her,in case of her death,and that
<br />reason of her death.prior to the death of said testatrix.,,��h--er share and interest in said residua
<br />estate lapsed and that as to said one -third interest in*.��lands and residue said Sarah M.Peterson
<br />died intestate,and that said one -third interest therein should be distributed according to the
<br />laws of descent in the state of Nebraskup
<br />The Court further finds from the proof on file and submitted to it herein that said Sarah M.
<br />Peterson left no husband, issue, or descendants surviving her,but did leave surviving her,as her
<br />only heirs at law,Cath&rine A.Mackey and Ella I. Snyder,her sisters.and Hurry McGrath.her nephew
<br />he being the only surviving child, issue, or deseendant,and only heir at law, of Martha McGrath,
<br />a deceased sister of said testatrix,said Harry McGrath being the same person named in the will
<br />of said deceased as one of the residuary legatees and devisees..
<br />The Court further finds that the said Edith Snyder Chaffee as one of the residuary legatees
<br />and devisees under said will was devised an undivided one -third interest in all of the above
<br />described lands and real estate situate in the state of Neb.raska;that said Harry MaGrath,as
<br />one of the residuary legatees and devisees under said will,was devised an undivided one -third
<br />interest in all of said real estate,and as one of the heirs at law of Sarah M.Peterson deceased
<br />inherite&.under the laws of descent in the state of Nebraska,an undivided one -ninth interest
<br />therein.making an undivided four - ninths interest in all of said real estate passing to him as
<br />devisee under the will and heir at law of said deceased;that said Catharine A.Ma.ckey. and Ella
<br />I.Snyder,einters,and being the other heirs at law of said Sarah M.Peterson,deceased.each inherited
<br />ti under the laws of descent of the state of Nebraska,an undivided one -ninth interest in all of sa d
