No. 13, HALL sCOUNTT <br />1 <br />1 <br />1 <br />FINAL DECREE W1Jd& AND CFRTIFICA <br />IN.THE COUNTY COURT OF HALL COUNTY,NEBRASKA. <br />In the matter of the estate of } <br />} FINAL DECREE. <br />David B.Morrison, }; <br />Deceased. ) Now, on this 26th day of Novembiar,1920, this cause came on <br />for hearing upon the final report of Joanna Morrison.Executrix of said estate,and her petition' <br />for a final settlement thereof,and it appearing from the proof on file herein that due and leg <br />al notice,as by law and the orders of this Court required,has been given to all persons inter- <br />ested in said estate of the filing of.said report and petition,and no objections beibg made <br />thereto,and upon the examination the Court finds that said report is in all respects true and <br />correct and should be affirmed and allowed herein. <br />The Court further finds that due and legal notice,as required by law and the orders of this <br />Court,ha,s been given to all creditors and other persons having claims against said estate, <br />of the time and place for filing same,that said time has expired,and that all claims filed <br />against said estate,together with the expenses of the last sickness and burial of said deceased, <br />and of the administration of said estate,have been fully paid,and that all other claims or de <br />of said estate,if any exist,should be and are forever barred and precluded. <br />The Court further finds that said deceased died testate in Hull County,Nebraska,on January <br />31,1920,and while a resident and inhabitant of said county,leaving a last will and testament <br />*hich has heretofore been duly filed,p roven,admitted to probate,and allowed in this Court as <br />by law provided;that said deceased left surviving him as his heirs and only heirs at law,,leg- <br />atees,and devisees,the following named persons; Joanna Morrison,his widow,and Clinton Morrison <br />and James Morrison,his sons,all of whom are over twenty -one years of age. <br />The Court further finds that said deceased died seized in fee simple of Lots twelve (12) and <br />Fourteen (14) in Foster's Subdivision of Lots eleven ((l) and twelve (12) of Woodlawn,a Sub- <br />division of a part of the southeast quarter of the northeast quarter,and a part of the north- <br />east quarter of the southeast quarter of Section Twenty-four (24),Township Ten (10),North, <br />Range Twelve (12) Westin Hall County,Nebraska,which premises were the homestead of said de- <br />ceased and his said widow,and that he also died seized of Lots Nine (9) and Ten (10),in Block <br />Three (3) of Clark's Addition to -the Village of Wood River,Hall County,Nebraska ;that under the <br />provisions of the last will and testament of said deceased the above described real estate <br />was devised,and passed and descended to the said Joanna Morrison,widow of deceased, -for and - <br />during her natural lifetime,and after her death,in equal shares to the above named cons of <br />said deeeased,and to their heirs and assigns forever;that said deceased also left personal <br />p roperty,as shown in the inventory,and Final report of saidExecutrix,and that there remains <br />in her hands for distribution,after the payment of all debts,costs,and Ebxpenses of administza- <br />tion,the sum of $2335.05 in cash,and one note of Ervin Wiltse,dated December 14,1918,due Dec- <br />ember 20,1918,for $406.18;also one note of Seborn Smith and Minnie Smith,dated November 29, <br />1918,due December 1,1919,for $500;one note of said Seborn Smith and Minnie Smith,dated Nov- <br />ember 29,1918,due December 1,1920,for $500iand one note of Seborn Smith and Minnie Smith,dated <br />December 29019188and due December 1;1921,for 4500,which three last described notes of the said <br />Seborn Smith and Minnie Smith were secured by a real estate mortgage on the south half of the <br />south half of Section 22,Township 5,North,Range 19 East of the Montana. Meridian,in Musselshel: <br />County,Montana .. <br />The Court further finds that under the provisions of the will of said deceased the above <br />described personal property,cash,notes,and mortgage,were bequeathed to and passed by and under <br />said will to the said Joanna Morrison,widow of said decea"d,in absolute fee simple,and that <br />same are so awarded to her,and she is instructed to make distribution as such Executrix to her <br />
