<br />The Court further finds that due and legal notice has been given to all persons interested
<br />in said estate of the time and place fixed for filing claims against said estate;that the time
<br />so fixed has fully expired,that all claims filed against sajd estate have been fully paid,and t
<br />all persons having claims against said estate,and not filed,if any such there be, are forever
<br />barred and excluded from setting up or asserting any such claims against a4id estate.
<br />The Court further finds that said Administrator has paid the funeral expenses of said de-
<br />ceasedthe expense of his last sickness,and the costs of administration,a,nd that there remains
<br />in his hands belonging to said estate,for distribution to the heirs of said deoeased,the sum
<br />of $2458.
<br />The Court further finds that the said George A.Wi.lson was an incompetent during his lifetime
<br />that his father axid mother both preceded him in death;that he was never married,and that he let
<br />surviving him,as his heire,at law,and_ his only heirs -it law,the following named persons,Sarah
<br />Taber,Della Ward,Eunice I.Wilson,and Jeanette Wilson Childe,all sisters of said deceased,and
<br />Oliver K.Wlson,a nephew,and Anna M.Wilson,a niece,the two layer being children of Orville
<br />Wilson,deceased,a brother of the said George A.Wilson,deceased,who died prior to the death of
<br />the said George A.Wilson,and that distribution of said sum of $2458,reviaining in the hands of
<br />said Administrator,should be made to the above named heirs of said deceased,in the manner pro-
<br />vided by the intestate laws of the state of Nebraska,and said Administrator has filed vouchers
<br />herein,showing payment of the sum of $491.74 each to the said Sarah Tabe'r,Della Ward,Eunice I.
<br />Wilson,and Jeanette Wilson Childs,and has paid iiato this Court 1245.87 for the said Oliver K.
<br />Wilson,and $245.87 for the said Anna M.Wilson,and nothing further remain of said estate to be
<br />y
<br />administered upon,and said estate ought to be settled and closed,and said Administrator die-
<br />charged.
<br />The Court further finds that the last will and testament of Benjamin Wilson,deceased,father
<br />of said George A.Wilson,deceased,was duly proven,allowed,and admitted to probate in this
<br />Court on the 8th day of July,1912,which said last will and testament contained the following
<br />provisions:
<br />"THIRD•I direct that the Probate Court of Hall County,Nebraska shall appoint a guardian for my
<br />son,George A.Wilson,to have charge of his person and esta.te,and it is my wish.and I direct that
<br />the following named parties shall be offered the position of guardian in the order in which I
<br />here name them:- Mrs Sarah Tabor,Mrs Della Ward,Eunice I.Wilson,Seanette Wilson.an.d the Masonic
<br />t
<br />Home at Plattsmouth,Nebraska,and that in case the first should fail to qualify. or after quali.fy4ng
<br />and acting as guardian for some time.should become disqualified by death,sickness or other dis
<br />abili ty, or should resign, that the said position of guardian be next offered to the next party
<br />above named in the order in which they are named and that the same proceedure be followed in ea0h
<br />case,should there be further refusals,disqualificatione.or resignations.
<br />That the guardian of said George A.Wilson shall be required to furnish for the said George A
<br />Wilson a good home.good and sufficient food anC clothing at all times,and to tenderly care for
<br />him in sickness and health,during the period of his natural life,in a loving,humane and paternal
<br />manner,and that if the duties of the said guardianship are not performed in the manner hereinbef re
<br />directed, that upon the matter being brought to the attention of the Probate Judge, the office s1*11
<br />be declared vacant,add' the next in order named as guardian,and the said guardian,while so actin,
<br />shall receive from the property of the said George A.Wilson,the income from the estate of the
<br />said George A.Wilson,and further,
<br />I give and bequeath,and devise that after the death of the said George A.Wilson,the real
<br />estate,in which the said George A.Wilson,in this my_ last will and testament.is given a life es-
<br />tate,together with the personal property then constituting a portion of said life estate,shall
