<br />Now, on this 7th day of Mai rch,1921,this cause carne on for hearing upon the petition of Willie
<br />A. Colwell, sole surviving Executor of the estate of Benjamin L. Colwe11, deceased.praying that said
<br />estate,and the decree heretofore entered therein,, be opened for the purpose of completing said
<br />administration and finding wnd determining the residuary legatees of said deceased,to whom were
<br />devised and bequeathed the residuary estate under Article 12 of the will of said deceased,here-

<br />tofore allowed.proven,and probated in this Court,and for such other `findings and orders in the
<br />premises as might be necessary for the final settlement of said estate.as by law provided.and it
<br />appearing from the proof on file herein, that due and legal notice as by law and the orders of thLe
<br />Court required has been given to the persons interested in said estate, including legatees.devis-
<br />ees.and the heirs at law of said deceased,of the filing of said peti.tion,by a publication for
<br />three weeks made in the "Grand Island Independent ".a legal newspaper printed and published in
<br />t
<br />said IIwll County,Nebraska,, of the time and place for hearing on said petition, that said time has

<br />fully expired.and there are no object -ions filed or made to said p --tition,and the Court finds,upo
<br />the evidence submitted in sup -port thereof,that the allegations made therein are true.wnd that
<br />said petitioner is entitled to have said estate re- opened and an amended decree filed herein.as
<br />in said petition set forth and or"yed.

<br />The Court further finds that by mistake and omission in drawing and entering the former decree
<br />of settlement of said estate entered herein.on September 3,1904,und of the findings of fact on
<br />which same was based,it was not made full and complete under the petition,proceedings,and final
<br />report of the Executors in said cause.in that same did not set out,determi.ne,and name the re-
<br />siduary legatees and devisees to whom were devised and bequeathed the residuary of the estate
<br />of the deceased,under Article 12 of his said last will and testament..
<br />The Court further finds that said Benjamin L.Colwell died seized of the northwest quarter
<br />of Section Twenty -nine (29),in Township Ten (10),North.Range Eleven (11) West.jn Hall County.

<br />hebraska,with other lands,wnd that said above described real estate was disposed of and devised
<br />by said will.und subsequently sold under the power of sale therein contained.by the Executors of
<br />said estate;that said deceased left surviving him as residuary legatees,to whom were bequeathed
<br />said residuary estate under Article 12 of said will.the following named persons,all of whom were
<br />originally named in the petition to probate said will.viz.,Matilda, Colwell,his widow,who died
<br />January 11.1904;1ilton R.Colwell.Oren T.Colwell.and William A.Colwell,his sons;Hannah T.Brittin.
<br />Sarah M.Brockle°hurst.and Melissa Burke rd, (afterwards Melissa Ball) his daughters;also Minnie
<br />Giddings and Ada M.Giddi.ngs,who were the daughters and only surviving children of Irri delia Gid
<br />-
<br />ings,a deceased daughter of swi.d Benjariiin L.Colviell,decea.sed;also Donnie Colwell and Bessie Col
<br />well,wllo were the daughters -end only surviving children of Peter C. Colwell, deceased, son of said
<br />Benjamin L. Colwell, deceased.
<br />The Court further finds from the evidence of said petitioner submitted herein that said
<br />Minnie Giddings granddaughter of said Benjamin L. Colwell, deceased. died.unmarri.ed and intestate,
<br />in�he State of Florida,about December 10,1903,leaving surviving her,as her only heirs at law..
<br />her fwther.Yiilton Giddi.ngs,and her sister,the said Ada M.Giddings,kho is also one of the de-
<br />visees under Article 12 of said will;that said Milton R.Colwell,son of said dece�sed,died,in-
<br />testate, in the state of Illinois. on Novembex 27.1903, leaving surviving him as his only heirs at
<br />1aaw,his widow,Ida Colwell.and his daughters,Belle Cline and Ad4a. Colwell;that all of the above
<br />named residuary legatees and devisees Lind heirs at law of the above named deceased legatees and
<br />devisees huve,since the former decree was entered in this estate.sold and convpy4d,by proper
