<br />Now on this 15th day of January,1921, this cause came on for
<br />hearing upon the final report of Josias Nieburger,deceweed,it satisfactorily uppeari.ng, to the
<br />court,from the proof now on file,th4t notice hus been given by publication to all persons inter-
<br />ested as required by the order of court dated December 22,1920,wnd there being no objection or
<br />protest on file.
<br />On examint.tion of said report the court finds that the same,is correct in all respects e,nd
<br />ought to be allowed and that said executor has accounted for all of said estate which came into
<br />his hands;that he has paid all claims filed and allowed against said estate as well as the costa
<br />of administration z.nd has paid all legacies provided for under the last will and testament,and
<br />there remains no property in his hands belonging to said estate.
<br />The court finds that notice was given to creditors of said deceused,in the manner provided
<br />by law,4s to the time "!lowed and place appointed for filing claims against said estate,that tY;
<br />time so allowed for filing claims has fully expired,and that all claims outstanding against sai
<br />deceased or his estate and not so fi.led,if there be "-n_y sucA,are therefore forever barred and
<br />excluded.
<br />The court finds that the sai.d Christian Nieburger departed this life on the 8th day of Feb
<br />1920,being at the time of his death a resident of Hall County,Nebrusku,and that he left a 'Last
<br />will and testament which instrument was duly proved,ullowed and admitted to probate in this
<br />court on the 24th day of April,1920,and recorded in this office.
<br />The court finds that the said Christian Nieburger died seized in fee of the following des-
<br />cribed real estate:
<br />The South half of the Southeast Quarter of Section 'Twenty -four (24) in Township Eleven (11),
<br />in Range Nine �9) in I1w11 County,::ebruska.
<br />The South half of the Southeast Quarter of the Northeast quarter of Section Thirty -six (36).
<br />in Township Eleven (11),in mange Nine (9) in Hall County,Nebr"ska,,
<br />The North half of the Southeast Quarter of the Northeast Quarter of Section Thirty -six (36),
<br />in Township Eleven (11),in Range Nine (9),in Fall County,Nebr"ska.,wnd
<br />The West half of the Southwest Quarter of Section Nineteen (19),in Township Eleven (11),in
<br />Range Eight (8) , in IWerrick County, Nebraska.
<br />The court finds that under the terms and provisions of the lust will and testament of the s
<br />Christian Nieburger all of the right,title and interest of the testator passed and descended at
<br />death to Anna Nieburger,his wi.dow,for her use and benefit during the term of her natural life,a
<br />that at her death said revel estate passes and descends in the manner following:

<br />the South half (Sj) of the South east Quarter (SEA) of the Northeast Quarter (I NE4) of Section
<br />36,i.n Township ll,in Range 9,all in Hall County,Nebr"ska,to Josias Nieburger,his son,in a.bsolut
<br />title,subject to the payment by the said Josias Nieburger of the sum of 1.1900.00;
<br />The West half of the South west Quarter of Section 19,in Township ll,in Range 8,in Merrick Coun
<br />Nebrusk",and the North half of the South east Quarter of the North east Quarter of Section Thirt

<br />six, (36 ), in Township Eleven (11), in Range Nine �9), in Hull County ,Nebraska., to Christian Nieburge
<br />his son,i.n absolute title,subject to the payment by the said Christian. Nieburger of the sum of
<br />$1200.00• The Court finds that the said Anna. Nieburger died on the 29th day of April, 1920.
<br />It is ,therefore,COTTSIDERED,ADTMED AND MCREED THAT all of the above described real estate
