<br />Now on this 10th day of November,A. D.1920, this cause came on
<br />for hearing upon the petition of Marie Johansen.asking for a decree determining the death,_:._ _a
<br />heirship and descent of real estate in the matter of the estate of Lars Johansen,Deceased,and
<br />it appearing to the satisfaction of the court.from the proof on file, that due and legal notice
<br />of the filing of said petition had been given by publication of notice in the Grand Island.Inde
<br />pendent.a semi - weekly_ news -paper published in said county,for a period of three successive week
<br />prior to the time set for hearing said petition,us required by law and the order of this court.
<br />had been given to all creditors,heirs- at- luw,and perenns interested in said estrate,and fixing
<br />a time for hearing said petition,whic.h time was more than thirty days and less than sixty days
<br />after the filing of said petition,oLnd there being no objections made thereto,the cause was duly
<br />submitted to the court upon the petition and the evidence. of Herman Nelson in support thereof,
<br />and the court being fully advised in the premises finds that the allegations of said petition
<br />are true;that said Lars Johansen died intestate in Grand Island,Nebraska,on November 27,1911$
<br />and that at the time of his death he was a resident of Hall County,Nebraska;that he died seized
<br />of an estate of inheritance in real estate located in Hall County.Nebraska,as hereinafter state
<br />that more than two years have elapsed since his deatu, and that no app.lioation has been made
<br />for the appointment of an administrator of his estate,no petition filed therefor.and that no
<br />administration has been had of his estate.,
<br />The court further finds that said deceased left surviving him as his heirs -at -law the foll-
<br />owing named pe rsons,to -wit: Marie Johansen.his widow,Anna Erickson,his daughter,Thorwald .Toh-
<br />ansen and Seier Johansen his sons,and that all of said heirs at law are more than twenty one
<br />years of age.
<br />The court finds that said deceased died seized of an estate in fee simpld to an undivided
<br />L;
<br />one half interest in the following described real estate situate in Hall County. Nebraska, to -witl:
<br />Lots Four (4) Six (6) and Seven (7) in Block Forty Three (43) in Packer & Barr's Second Additio
<br />to Grand Island,Nebraska;that upon his death said interest of the deceased in said real estate
<br />did pass and descent,by operation of law,49 follows:- To Marie Johansen,his widow,a one third
<br />interest in fee;to Anna Erikson.his daughter and Thorwald Johansen and Seier Tohunsen,his sons,
<br />each a two ninths interest in fee.
<br />The court further finds that all funeral expenses of said deceased have been paid,and that
<br />all debts of said deceased and of his estate.if any exist.are forever barred and precluded.and
<br />that the costs of these proceedings have been fully paid.
<br />IT IS THERFORE BY THE COURT ADJUDGED,CONSIDERED,AND IECREED,That the said deceased died
<br />intestate more than two years prior to the filing of the petition in this cause,that no applice
<br />tion for the appointment of an administrator of his estate has been made,and there has been no
<br />administration of his estate in the State of Nebraska,that he died seized in fee simple of an
<br />estate of inheritance in Hall County,Nebra.ska , as above set forth.that he left surviving him
<br />as his heirs -at -law the above named persons who bore the degree of kinship to him of sU:rviving
<br />wife and children.that the above described real estate passed and descended to the above namee
<br />heirs- at -luw in the shares hereinafter set forth,to- wit :To Marie Johansen,& one third interest,
<br />to Anna Erikeon.Thorwald Johansen and Seier Johansen.each an undivided two ninths interest
<br />in fee. That the same is hereby so awarded to them "a provided by the laws of the State of
<br />Nebraska;that all debts of said deceased or of his estate.if any exist. are forever barred
<br />"nd precluded.and that further administration of his estate is hereby dispensed with,and said
<br />
