Newton, Deceased. ) Now on this 6th day of September,1919,this cause came on for hearing upon the final report of Charlie C.Newton,Administrator of the estate of Edwin F- Newton, deceased,it appearing to the satisfaction of the Court that notice was given to all persons in- terested as required by law and the order of court dated August 21,1919,and there being no objet - Uon or protest on file. On consideration of the report,the files and ',the testimony the court finds that said adminis- trator has accounted for all of the estate of said deceased which came to his possession or undo hi's co-n�rol and.that he has now in his possession for distribution,after paying funeral expenses and costs of administration the sum of $2209.58 and that said report is correct in all respects and ought to be allowed. It is therefore considered by the court that the report of Charlie C.Neoton,administrator, be and the same is. hereby approved and allowed as and for his final account and that upon his filing in this court the receipts of the heirs at law of said Edwin F. Newton, deceased, for their respective ahares of the personal property in the hands of the administrator,as found above,he be discharged of his trust and his bond released.. T2*fcourt finds that notice was given to all creditors of the said Edwin F.Newton,deceased,, as to the time allowed and place appointed for filing claims against his estate and that said time has fully expired;that all claims outstanding against said Edwin F.Newton,if any such there be,are therefore,forever barred and excludedp,'The court finds that no claims were filed against said estate. The court further finds that said $dwin F.Newton departed this life on the 23rd day of Dec- ember,1918,a resident of Hall'County,Nebraska,and that he died intestate,leaving surviving him as his heirs at law, and his only heirs at law, the following homed persons:- Melissa J. Newton, his widow,and Alice Beerup,Minnie Rickard,Leona Seeber,Mabelf'Searson and Edna M.Hammond,his dau- ghters,and Charlie C- Newton,his son,and Jesse Hammond,son of Jessie Hammond,a deceased daughter, his grandson. The court finds that the said Edwin F.Newton died seized in fee of the following described real estate situate in the County of Hall and State of Nebraska,to -wit: The South half of the South -east Quarter (S* of SEA-) of Section Twenty -eight (28),in Towns Eleven (11),in Range Eleven (11),west of the 6th P.M.,and that under the provisions of the law of descent of real property in the State of Nebraska,the above mentioned and described real as did pass and descend at the death of the said Edwin F.Newton,intestate,in the manner following: To Melissa J.Newton,his widow,one third part thereof in fee; To Alice Beerup,Minnie Rickard, Leona Beebe r, Mabelf-Sears on,Edna M.iiammond,,Ch -rlie C.Newton and Jesse Hammond,the remaining two- thirds port thereof in equal shares as tenants in common,subject only to the homestead ri &ht of the said Melissa J.Newton therein. It is, therefore,OREERFD,AWMED AND 19CREED by the court that the above mentioned and des- cribed real estate did pass and descend i6t the death of the said Edwin F.Newton as follows: One third part thereof to Melissa J.Newton and two - thirds part thereof to Alice Beerup,Minni Rickard,Leona Seeber,MabelY.Searson,Rdna M.Hammond,Charlie C.Newton and Jesse Hammond in equal shares,subject to the homestead right of the said Melissa J.Newton therein,and the court awardslit to them.
